EXPULSION: APC MEMBERS SUE SEN ISHAKU ABBO, ASKED COURT TO RESTRAIN HIM FROM RE-CONTESTING




It is not yet uhuru for Ishaku Abbo, Senator representing Adamawa North Senatorial District, as two Members of the All Progressives Congress(APC) have instituted a suit, seeking for an order to restrain him from re-contesting. 


The plaintiffs, Abdullahi Suleiman and Yusha'u Usman of Kolere and Sabon Layi wards, Mubi North LGA, respectively, dragged Sen. Abbo, before the Adamawa State High of Justice seeking for an interpretation regarding his status in APC.


Already, the court presided by Hon. Justice Danladi Mohammed, has granted leave to the Applicants through exparte application to serve the Senator with the originating summons and other accompanying processes filed in the suit outside the jurisdiction of the court precisely in the FCT Abuja.


Hon. Justice Danladi, also ordered for substituted service of the originating process to be effected on the Senator by depositing the originating summons, its accompanying processes at the National Assembly complex, Abuja and same is  deemed as proper service.


The order followed an application brought pursuant to order 6 rule 1 and order 10 rule 1 and 2 of the rules of the court . The originating process was filed on the 12th December, 2022 by Abubakar Ali Esq, Counsel to the Plaintiffs.


After issuing the order on Tuesday, 12th day of December, 2022,  the court however adjourned the matter to the 15th December, 2022 for mention.


In their suit, the plaintiffs have sought for an interpretation of the following questions inter alia : whether by virtue of Article 21.4 (i) and Article 21.5 (iv) of the constitution of APC, 2022, the Senator and the party are not bound by the resolution of APC Mubi North LG Exco dated 7th October, 2022.


Likewise, the plaintifs prayed for an order of perpetual injunction restraining Sen. Abbo from parading himself as candidate of the party in Adamawa North Senatorial District in the forthcoming general election.


They have further sought for a declaration that the Senator and APC are bound by the resolution of Mubi North LG Exco dated 7th October, 2022 and that the Senator is not entitled to enjoy any rights or privileges accorded to members of the party.


NEWS PLATFORM recalled that the Mubi North LG Exco of the party had on the 7th October, 2022, approved the expulsion of the embattled Senator as recommended by the party's Disciplinary Committee.


After his expulsion, a notification letter dated the 14th October, 2022 signed by the Acting Chairman of the party in the State, Samaila Tadawus, was forwarded to the the National Chairman of the party but could not act on it within 14 days as required by the APC constitution.


 Article 21.4 of the party's constitution guarantees a right of appeal to any aggrieved party to the State Exco within 7 days, but the Senator was said to have refused to appeal the decision of his expulsion from the party.


It is against this background that the plaintiffs approached the court seeking an interpretation regarding the status of Senator Ishaku Abbo's  in APC.
