APPEAL COURT DIDN'T CONVICT, BAR ME FROM HOLDING PUBLIC OFFICE- EX-REP ABBA GIREI

Immediate past member who represented Girei, Yola North and Yola South Federal Constituency, Hon. Salihu Mohammed (aka Abba Girei) has clarified that the court of appeal did not convict or bar him from holding public office.

Hon. Salihu was sacked by the appeal court sitting in Abuja, while delivering judgement in an appeal instituted against him by the Candidate of the APC, Hon. Baba Zango, recently.

The court nullified the judgement of the election petition tribunal sitting in Yola, Adamawa state and declared Hon. Zango as the authentic winner of the election for the constituency.

Addressing newsmen, Hon. Abba, clarified that he was neither convicted nor barred from holding public office based on the judgement of the appellate court, saying that the issue was an election matter and not criminal case.

"I am very disappointed with that judgment because the judgment was not based on the facts and documents I had presented before the Court. I know that the Court of Appeal is the final court of appeal in this kind of case, but that does not mean it is infallible.

"The Court based its judgment on the evidence of a fake Assistant Headmaster (Mohammed Alhaji Yusuf) (PW4) instead of relying on the evidence of the Headmistress of Wulari 1 Primary School, Maiduguri (Hajja Gana Abubakar), who attended the tribunal and tendered all the school records showing that I did not forge my primary school certificate and that my certificate is authentic", said Hon. Abba.

He explained that the Court said “Salihu” is different from “Salisu” and “Saliu”; and the court ignored the Supreme Court decision that “Mohamadu” and “Mohammed” are the same in the case of Atiku Abubakar V. INEC (2020).

"The Court said I was born on 16th March, 1983 instead of 16th March, 1979 which is my correct date of birth as was affirmed by a Deputy Director from Maiduguri Metropolitan Council who tendered official records of the issuing authority, and affirmed that my birth certificate was not forged.

"A Deputy Director under Medical and Health Department, responsible for registration of birth and deaths, etc. (Hamza Buka) (RW4) stated that Salihu was born on 16th March, 1979 in Maiduguri, Borno State", he added.

According to him, the Court relied on documents which were not part of the documents he submitted to INEC, saying that the court said that "I did not attend any Secondary School, and disregarded my NECO Certificate which clearly shows that I attended Government College, Maiduguri".

He said "The court disregarded the evidence of the four Subpoenaed witnesses (the Headmistress, the Examinations Officer, the Education Secretary and the Deputy Director, all from the Maiduguri Metropolitan Council who gave evidence and tendered documents to show that the Certificates I submitted to INEC were genuine, and not forged.

"There was no official disclaimer of my certificates, yet the Court said my documents were forged just because of the wrong spelling of the name “Salihu” as “Saliu” and “Salisu”. Again, the Court of Appeal refused to follow the Supreme court judgement in Oyetola v. INEC (2023).

Hon. Abba pointed out thus:"Ordinarily, from the above observations, I would have lodged an Appeal at the Supreme Court if the 1999 Constitution permitted that but unfortunately I cannot seek redress at the Supreme Court.

"Therefore, I call on the National Assembly to set the machinery in motion to amend the Constitution to allow appeals in all election matters to end at the Supreme Court. My confidence in the judiciary remains firm, but from the above observations in this judgment, it is clear that the Court of Appeal should not be allowed to be the final Court of Appeal in this kind of sensitive matters that has to do with the legitimate mandate of the people.

"Where is the justice to the people, if the candidate who scored 71,223 votes is dropped in favour of the candidate who scored 54,335 votes just because of spelling mistakes in my name? I have been denied justice; and how I wish I had the remedy to seek redress at the Supreme Court.

"However, I take it in good fate, but it is important that I address this press conference to correct some wrong impressions that I was convicted or that I will not hold any public office again. I have not been convicted by the Court of Appeal; and the Court of Appeal did not bar me from holding any public office. This was an election matter and not a criminal case.

"Therefore, I did not forge any certificate and I call on the police to investigate this matter thoroughly. The schools I attended are still in existence. You can conduct your own independent investigations. Wulari 1 Primary School, Maiduguri issued my Primary School Certificate, and they affirmed the genuineness of my certificate. Maiduguri Metropolitan Council issued my birth Certificate, and they affirmed the genuineness of my birth certificate", stated Hon. Abba.

Adamawa State Governorship Election Petitions Tribunal sitting in Yola, Adamawa State on Saturday, dismissed petition filed against Governor Ahmadu Umaru. NEWS PLATFORM

The petition was filed by the Governorship Candidate of the All Progressives Congress, Aishatu Dahiru Binani and her party challenging the election of Governor Fintiri of the PDP.

Delivering judgement, the Chairman of the 3-member panel, Theodora Obi Uloho, said that petitioners woefully failed to establish their allegations of non- compliance with the electoral act and prove their case with cogent, credible and satisfactory evidence.

According to her, all documents tendered by the petitioners were dumped on the tribunal and that their star witness did not demonstrate any of the documents to link it with any of their material allegations in the petition.

She said that the court is an adjudicator and not an investigator, saying that all the witnesses of the petitioners came with documentary hearesy and failed to prove their case beyond reasonable doubt.

On declaration of Binani as winner of the poll by the suspended REC,Barr. Hudu Ari Yunusa, she declared that the declaration by Hudu is null and void and that the former REC acted Recklessly because it is not his function to collate, announce and declare winner of the election.

She added that the role of Barr. Hudu Ari is supervision and administration, saying it is the Returning Officer (RO) that is empowered by law to collate, announce and declare the winner of elections.

She said that the petitioners also failed to prove beyond allegation of over-voting and non accreditation of voters, saying that the petitioners ought to tender BVAs used in conducting election across all polling units.

In their petition marked No. EPT/AD/GOV/1/2023, Binani and APC joined the Independent National Electoral Commission, INEC, Ahmadu Umaru Fintiri and the PDP, as 1st to 3rd respondents respectively.

Binani and APC jointly filed the petition on the 6th May, 2023, alleging that the election conducted on the 18th March, 2023 and 15th to 18 April, 2023 was marred by thuggery, ballot papers and BVAs snatching, harassment of the electoral officers and several other offences.

According to them, the election was violated by substantial non-compliance with and breaches of the mandatory statutory requirements of the Electoral Act and regulations made thereunder, which substantially affected the validity of the election that none of the candidates can be validly returned as having won the election.

The petitioners averred that Fintiri's election was invalid by reason of non-compliance with the provisions of the Electoral Act, 2022, arguing that Fintiri was not duly elected by the majority of lawful votes cast during the election.

Binani asked the tribunal to declare her validly elected and return as winner of the exercise, and also prayed for an order of the tribunal directing INEC to issue her with certificate of return as the duly elected Governor of Adamawa state.

Equally, she sought for an order declaring null and void the certificate of return issued to the 2nd respondent, Governor Fintiri by the electoral umpire, and alternatively order INEC to conduct fresh governorship election in the state.

In his reply, Ahmadu Umaru Fintiri, vehemently denied all the catalogue of allegations as contained in the petition, saying that the election was conducted in substantial compliance with the Electoral Act 2023.

BREAKING: TRIBUNAL THROWS OUT PETITION AGAINST GOMBI LEGISLATOR

The National/ House of Assembly Election Petitions Tribunal sitting in Yola, Adamawa State on Wednesday, dismissed petition against the member representing Gombi constituency at the House of Assemnly, Hon. Japhet Kefas.

The three-man justices, in a unanimous judgment, stated that the candidate of the APC, Hon. Rufai Umar failed to provide substantial evidence to prove the case.

In his petition filed on the 4th April, 2023, Hon. Rufai Umar alleged that the election which saw Hon. Japhet Kefas of PDP emerging the winner was not in substantial compliance with the Electoral Act and sought for its nullification.

FORMER SENATOR BINANI AND 2023 CONSTITUENCY PROJECTS

By Muhammad Shamsuddeen Bello

AIA MEDIA TEAM.

- Do the Cars Presented Part of Our 2023 Constituency Projects or Her Personal Property?

- Is Binani Still the Senator Representing Adamawa Central or She's Still Campaigning For the Governorship?

- Where Are the Remaining Fertilizer and Other Constituency Projects Meant For Adamawa Central Senatorial Zone?

As concern citizens and Adamawa central senatorial district electorates, we are writing this piece to seek for detail explanation regarding the recent distribution of about 50 cars to "ONLY" All Progressives Congress (APC) diehards and "Binani's" loyalists.

We are not objecting or writing against the gift/empowering her political loyalist, rather we only seek for clarification on either the cars are part of the constituency projects of the Adamawa Central Senatorial district constituency project 2023.

If the cars are part of the 2023 constituency projects then Senator Binani is not fair to her self and the people of Adamawa central by giving them less than what is expected in the multi million naira constituency projects as the gesture was not utilized for the purpose intended.

This considering the fact that, even those from other senatorial zones of the state benefited, despite having their own from Senator representing Southern Senatorial District and even those from Northern Senatorial Zone have their own before a court judgement recently sacking the senator.

Normally, it's a tradition in both the lower and upper chambers that lawmakers who are not returning to the National Assembly do hand over all the ongoing constituency projects in their jurisdiction to their successors to continue from where they have left, but we wonder why her own case is becoming different.

Why can't she hand over to the serving Senator Representing Adamawa Central to continue with the distribution of the constituency projects? or she is still campaigning for the Governorship in the State, while His Excellency the Governor of the State Rt. Hon. Ahmadu Umaru Fintiri is busy fulfilling his 8th Point Agenda's to the people of the state.

As we have said earlier, the constituency projects meant for the people of Adamawa Central Senatorial District were donated to some selected groups/ individuals in the state who were said to have pushed the Binani's train during the 2023 electioneering campaigns irrespective of their Senatorial district

It is clear to all of us that, constituency projects are properties belonging to the electorate who have representative in either National or State Assemblies and projects meant for execution in respective constituencies all over the country must be executed to the satisfaction of the electorate and that the political elites must also not see themselves as the sole owners of that projects.

People of Adamawa Central Senatorial District need Justice on their 2023 Constituency projects and will not condone any act of conversion of their projects for cheap politicking to keep her political allies together, forgetting that 2023 election is over and gone for good.

We equally thank God for not making such a person to be the governor of our land of beauty and home to peace loving people of Adamawa State.
