MUBI/MAIHA: JA'AFAR GOES TO APPEAL COURT, VOWS TO RECLAIM TICKET




Embattled Member representing Mubi North, Mubi South and Maiha at the House Representatives, Hon. Ja'afar A. Magaji, has appealed the court verdict which voided primary election that gave him ticket to re-contest.


Hon. Ja'afar, who is seeking re-election, has appealed the judgement of the Federal High Court, and vowed to legally challenge the decision in order to reclaim his mandate. 


The court presided by Hon. Justice A. M. Anka, invalidated APC primary election which produced the incumbent member representing the constituency as flagbearer. 


Justice Anka who declined to order for fresh election for the federal constituency, ordered Hon. Ja'afar, to stop parading himself as the candidate of the party.


Hon. Ja'afar, in a notice of appeal filed through his team of lawyers, M. Y. Abdullahi (SAN), Abubakar Ali and 8 others, averred that the lower court erred in law and same occasioned a miscarriage of justice against him.


He observed that the lower court erred when it erroneously held in its judgement that the primary election was invalid.


He prayed for an order allowing his appeal, setting aside the judgment of the lower court as well as an  order dismissing the plaintiffs’ suit.


He also sought for an order upholding the declaration that he is the winner of the primary election conducted on 27th May, 2022, in Mubi North, Mubi South and Maiha Federal constituency.


Furthermore, he asked the court to declare him the lawful candidate of the party in the forthcoming general election and any other the court of appeal may deem fit to make in the circumstances of this appeal.
