COUNCILLOR, TRADITIONAL RULER REGAIN FREEDOM AFTER 18 DAYS IN YOLA PRISON



Respite came the way of the Councillor representing Modire Ward in Girei Local Government Area, Adamawa state, Hon. Paul Danladi, and the Ward Head of Fombina, Zira Garba Masi, on Friday, as the Chief Magistrate Court 2 granted them bail after they had spent 18 days in prison custody.


The Councillor and the Traditional Ruler were remanded in Yola Correctional Center by the court on Monday, 19th July, 2021, following an application for the revocation of bail by counsel to the complainants, M. A. Adamu (Senior State Counsel 2).


Adamu, had applied that the bail granted to the duo be revoked since they deliberated refuse to obey the order of the court by interfering and threatening the lives of some of the complainants/witnesses involved in the matter.


On their part, counsels to the 1st defendant, Mohammed Abubakar of the Legal Aid Council of Nigeria, and that of the 2nd and 3rd defendants, M. P. Dangi, who represented M. M. Tumba, urged the court to refuse the application, and prayed it to give them time to appropriately respond to the bail application.


Hon. Paul, Masi and the Village Head of Modire, Mohammed Bello Modibbo, are standing trial over alleged criminal conspiracy, intimidation, treespass and mischief slammed against them by 19 people including civil servants.


Ruling on the application, Magistrate Japhet Ibrahim Basani, revoked the bail granted to the 2 defendants, and ordered that the defendants be remanded at Yola Correctional Service Facility, and adjourned the matter to 14th July, 2021 for continuation of hearing.


However, following a joint application for bail filed by counsels to the defendants, the court on Friday the 6th August, 2021, okayed their release on bail pending the determination of the matter.


Magistrate Basani, warned the defendants to desist from interfering in the disputed land, harassing or intimidating complainants/ witnesses, and adjourned the case to the 11th August, 2021 for continuation of hearing.


Earlier, in their application, counsels to the defendants, Mohammed Abubakar of the Legal Aid Council of Nigeria and M. M. Tumba, told the court that their clients will not in any way interfere or intimidate anybody and pleaded with the court to admit them to bail. 


On his part, counsel to the complainants, M. A. Adamu, who could not object to the application, urged the court to be strict on the conditions of the bail, and prayed the court to grant the matter accelerated hearing.
