A/COURT RESERVES JUDGEMENT IN APPEAL AGAINST EX-ADHA SPEAKER

The Court of Appeal Abuja Division on Monday, reserved judgement in an appeal filed against the member representing Yola South constituency and former Speaker of the assembly, Rt. Hon. Kabiru Mijinyawa.

The court reserved judgement in the appeal filed by the Candidate of the PDP, Hon. Adamu Baba Mustapha after hearing, and said that the date of judgement will be communicated.

Rt. Hon. Kabiru Mijinyawa and former speaker of the assembly was re-elected during 2023 poll under APC platform to represent his constituency for the 3rd term.

In his appeal, Hon. Baba Mustapha is contesting the recent judgement of the National /House of Assemnly Petitions Tribunal which dismissed petition he had instituted against Rt. Hon. Kabiru.

Earlier, in his petition, Hon. Baba Mustapha alleged that the election held on the 18th March, 2023 was invalid, null and void by reasons of non compliance with the electoral act.

On his part, the former Speaker was of the view that the exercise was in substantial compliance with the electoral act, and that the petitioner did not participate in the election.

He told the tribunal that the petition was premised on pre-election matter, and that its lacks jurisdiction to entertain it, and described the petition as incompetent, frivolous and ought to be dismissed in its entirety.
