YOLA COURT ACQUITS 2 POLICE OFFICERS OF MURDER, ORDERS IGP TO REINSTATE THEM


 

After about 8 years of trial, the Adamawa State High Court presided by the Chief Judge, I. K. Banu, has discharged and acquitted two police officers earlier accused of murder.


Justice I. K. Banu, further ordered the Inspector General of Police to reinstate the officers, insisting that the dismissal of the defendants from service was unlawful. 


The police officers, Sergeant Joseph Adamaku and Corporal Iliya Yawa, have been standing trial for culpable homicide not punishable with death contrary section 222 sub 7 and punishable under section 224 of penal code law. 


Sgt Adamaku and Cpl Yawa had while on stop and search duty along notorious Toungo-Lainde-Chitta road in Toungo Local Government Area in the state caused the death of one Jibo Maidawa on the 26 December, 2014.


The officers were said to have employed their service rifles in a manner characterised by excessive haste and without due care and shot at Jibo while trying to repel an attack from him, and that the deceased died from the injury he sustained.


But after evaluating the evidence tendered in court, the Chief of the state held that all issues raised by the defence and the prosecution were resolved in favour of the defendants.


He declared that the defendants are entitled to the defence of self defence, and that the prosecution has failed to prove its case against them as required by the law.


He however discharged and acquitted them of the 2 count charges and ordered the IGP to reinstate them back to service accordingly.
