COURT STRIKES OUT GOVT APPEAL AGAINST 659 SACKED BATCH D1 TEACHERS





Yola Appeal Court in Adamawa State on Friday, struck out an appeal filed by the state government, challenging the verdict of the National Industrial Court on 659 Batch D1 Teachers.


The Industrial Court had in its judgement delivered by Justice NCS Ogbuanya, on Wednesday 13th June 2018, declared as illegal  sacking of 659 Batch D1 Teachers.


However, Justice Ogbuanya, ordered Adamawa State government to pay the whooping N660 million to the affected teachers who had served for the period of 29th months before their appointments were terminated.


Likewise, the court in suit No. NICN/YL/03/2015, ordered government to pay another N22 million to the teachers as damages for failing to pay them as at the time of the judgement.


NEWS PLATFORM recalls that the teachers were recruited in September 2010 by the erstwhile Governor Murtala Nyako led administration through ministry of education.


They were employed as Assistant Education Officers on grade level 07/1 by the Post Primary Schools Management Board and posted to various Secondary Schools sometimes in August 2012.


Disastified with the court's decision, the government in an appeal No. CA/YL/129/2021, asked the court to set side the verdict of the lower court.


The appellants filed its appeal on 5 grounds where it argued that the trial judge misdirected himself in law and facts, insisting that the misdirection occasioned miscarriage of justice.


But delivering his judgement, Hon. Justice F. Akinbami, of the Appeal Court Yola Division, struck out the appeal for being incompetent.


Reacting on the judgement, Counsel to the appellant, U.J who appeared along side M.A Umar, and L.M Dodo, thanked the court for its time in delivering its judgement.


On his part, counsel to the respondents, M. P. Atsev, said that his clients are happy with the judgement, and thanked the court.


On his part, the spokesman of the teachers, Fredrick Mbashi, described the judgement as wise decision, and appealed to the affected teachers to remain calm and law abding.


But reliable sources informed NEWS PLATFORM that the appellants who said the appeal was just struck out but not dismissed, they are going to study the judgment and do the needful soonest.


According to the sources, the matter is yet to be heard on merit or substantive, saying that live issues are not yet determined.
