The hearing in suit seeking to disqualify APC Gubernatorial Candidate in Adamawa State, Aishatu Binani, has been slated for 20th July, 2022 by the Federal High Court 1 Yola Division.
Aside the hearing in the substantive suit instituted by APC Governorship Aspirant, Mallam Nuhu Ribadu, the court will hear all the pending applications filed by Ribadu, Binani and APC.
NEWS PLATFORM reports that some of the pending applications slated for hearing include; motion on notice, originating summons, notice of preliminary objections, motion on the extension of time and counter affidavits.
In his motion on notice, Ribadu is not only seeking for the nullification of the primary election conducted on the 27th May, 2022, but the disqualification of Binani, who was declared winner of the exercise.
The former EFCC Chairman who is alleging over voting, votes buying and delegates inducement, wants the court to disqualify Binani, and be declared the duly elected candidate of the party.
He sought for an order restraining APC from submitting Binani's name to INEC as governorship candidate of APC on grounds that she had emerged from an invalid, unlawful exercise.
More so, in his response to APC and Binani's notice of preliminary objections, Ribadu, through his Counsel, Matthew Burkaa(SAN), urged the court to dismiss the notice of preliminary objections.
He further submitted that the commencement of the suit marked FHC/YL/CS/12/2022, was done in accordance with the rules of the court.
But in their separate replies to motion on notice file by embattled Ribadu, APC and Binani through their Counsels, Sule J. Abul and Sam Ologunorisa, filed notice of preliminary objections and counter affidavits.
While APC is challenging the jurisdiction of the court to entertain the matter, Binani in her preliminary objection argued that Ribadu's suit was not properly constituted.
She described the suit as incompetent, contentious, rancorous and contains allegations of fraud commission of crime, and that it cannot be heard or determined by way of originating summons.
After Counsels' submissions, the court presided by Hon. Justice A. M. Anka, adjourned the case to the 20th July, 2022 for a hearing in substantive suit and pending applications.
Speaking to newsmen shortly after the sitting, Counsels to Ribadu, APC and Binani, said," We have all agreed to come and argue all the applications as well as the substantive suit on the adjourned date".
