The Independent Corrupt Practices and Other Related Offences Commission (ICPC) is to formally launch the Accountability and Corruption Prevention Programme for Local Governments in Nigeria (CPP-LG) aimed at tackling systemic corruption and promoting transparency at the grassroots level in the country.

This development follows recent legal affirmations of local government autonomy, which are expected to strengthen their financial independence and operational efficiency.

The Chairman of ICPC, Dr. Musa Adamu Aliyu, SAN, who revealed the plan on Wednesday during a summit organized by the Gombe State government on "Local Government Autonomy, Fiscal Responsibility, and Sustainable Development,” explained that the initiative will enhance accountability and fiscal responsibility within local government administration in Nigeria.

Presenting a paper titled “Enhancing Transparency and Accountability in Local Governance: Strategies for Combating Corruption in Nigeria,” Dr. Aliyu underscored the pivotal role of local government administration in delivering essential services to grassroots communities.

However, the ICPC boss lamented the persistent embezzlement, nepotism, contract inflation, and resource misallocation that have long plagued the local government system.

His words, “Systemic corruption undermines the effectiveness of local government functions, leading to inefficiencies, misallocation of resources, and eroded public trust. The lack of transparency and accountability further exacerbates these challenges, creating an enabling environment for corrupt practices,”.

Dr. Aliyu emphasized the need to strengthen legal and institutional frameworks as part of comprehensive strategies to improve governance at the local level.

These strategies include enhancing financial autonomy, professionalizing local government services, encouraging citizen participation, strengthening institutional mechanisms, and enforcing existing anti-corruption laws.

He explained further that the ICPC has already begun implementing mechanisms to monitor and evaluate local government performance, noting that these measures include regular audits, public reporting, and promoting citizen engagement in governance processes.

The ICPC Chairman noted with delight that the Commission is set to formally launch the Accountability and Corruption Prevention Programme (CPP-LG) as part of its broader anti-corruption efforts in the tier of government o.

“Enhancing transparency and accountability in Nigeria’s local governance is crucial for combating corruption and fostering a more equitable society. By fortifying legal frameworks, leveraging technology, encouraging civic engagement, building institutional capacity, and fostering international cooperation, Nigeria can create an environment where integrity thrives,” Dr. Aliyu asserted.

According to him, a collective commitment to the anti-corruption fights with all stakeholders, including government agencies, civil society organizations, the private sector, and the international community is a must if Nigeria is to reduce the menace of corruption and other social vices in the country.

“The fight against corruption demands collective action and unwavering dedication. Nigeria can make significant progress in eradicating corruption by working together and upholding a shared vision of integrity and accountability.

Though the journey may be challenging, the rewards of a corruption-free society—where resources are utilized for the public good and every citizen can thrive—are immeasurable. Through sustained effort and commitment, Nigeria can build a brighter and more prosperous future for all,” Dr. Aliyu concluded.

NEW CHIEFDOMS, EMIRATES: Fintiri Clarifies Directives on Title Holders Removal

By Humwashi Wonosikou

Chief Press Secretary to the Governor

There's been a mischievous misrepresentation circulating on social media that Governor Ahmadu Umaru Fintiri of Adamawa State has removed all District Heads and title holders.

However, the Governor has only directed concerned District Heads that have traditional titles from their previous traditional councils to  drop those titles and pledge loyalty to their new Chiefs and Emirs.

This directive affects only those who have titles from their former councils and is actually a part of the Governor's efforts to promote harmony and unity among the traditional institutions in the state. With the creation of new Chiefdoms and Emirates, District Heads who have titles from their former councils are expected to seek titles that align with their cultural traditions and heritage from the rightful custodians of their culture.

Emirs and Chiefs of new Traditional councils that wish to confer new traditional titles on their District Heads should seek approval to do so.

It's unfortunate that some individuals have resorted to using AI to twist what the Governor said in order to spread misinformation and tarnish the image of the Governor and the government. The Governor's policy aims to promote cultural preservation, unity, and progress in Adamawa State. These are the exact words of the Governor:

“As a policy, I call on all the district heads concerned to transfer their loyalty, rights and privileges to the new emirates and chiefdoms. Hence, traditional titles acquired from their old emirates and chiefdoms are to be dropped. The constituted traditional councils of the new emirates and chiefdoms, are therefore directed to recommend new titles for the district heads for approval in line with the statutory dictates of the tradition.”

“On behalf of my family, I extend my deepest condolences to the Clark family, the people of the Niger Delta, and indeed all Nigerians".

Defend Yourself in Court, INEC Tells Hudu Ari

The Independent National Electoral Commission (INEC) has advised the sacked Adamawa Resident Electoral Commissioner (REC), Hudu Yunusa-Ari, to approach the court and prove his innocence rather than making spurious allegations in the media.

Yunusa-Ari, who was sacked over his controversial declaration of Senator Aishatu Dahiru (Binani) of the All Progressives Congress (APC) as winner of the 2023 Adamawa governorship election while collation was still ongoing, resurfaced at the weekend in Bauchi State at a press conference with allegations that the electoral umpire suppressed evidence proving Binani’s victory.

He accused the commission’s leadership of ignoring critical documents that could have altered the poll’s outcome.

Despite being suspended on April 17, 2023, Yunusa-Ari maintained that he acted lawfully and denied allegations that he accepted a N2 billion bribe to make the declaration.

Reacting to Yunusa-Ari’s remarks about the governorship poll, Chief Press Secretary to the INEC Chairman, Rotimi Oyekanmi, stated that the commission saw nothing new in the assertions.

He emphasised that the election dispute had already been conclusively settled, with the Supreme Court delivering the final judgment.

INEC also made it clear that it would not comment on Yunusa-Ari’s controversial conduct during the election’s concluding stages, as the issue was before the High Court in Yola.

Oyekanmi said since Yunusa-Ari had returned to Nigeria, INEC insists that he should submit himself to due legal process rather than attempting to justify his actions through public declarations.

He said: “Our attention has also been drawn to the interview granted by the former REC of Adamawa State, Hudu Yunusa-Ari. There is nothing new in what he said.

“In any case, the substantive matter of the 2023 Adamawa State governorship election has been determined through the appropriate judicial process from the trial tribunal to the Appeal Tribunal, and finally settled by the Supreme Court.

“The Commission will not comment on the propriety or otherwise of his conduct during the concluding part of the election as the matter is right now the subject of litigation at the High Court sitting in Yola, and therefore subjudice.

“Now that he is back in the country, the right place to prove his innocence and the propriety of his action is by availing himself for the due process of law, and not a press conference.”

NCC, NLC AND THE 4TH OF FEBRUARY PROTEST

By Ahmad Sajoh

There are times when it becomes absolutely necessary to empathize with Nigerians over situations that are manifestly adverse. However, sympathy or empathy does not mean overlooking reality. Honestly, that is the situation we are in with the recent tariff adjustment by the telecommunication operators in Nigeria today. Nigerians may be famous for being resilient, but any increase in cost of living stretch such resilience further. But looking at the situation realistically one must be honest in accepting that the dangers of denying the Telecom Operators a cost reflective tariff adjustment at this point in time may be more costly to the consumers in the long run than allowing them adjust their tariffs. Expansion of access and service efficiency are more important even to the consumers than keeping a cap that blocks expansion and better quality service. Perhaps allowing them to adjust their tariff to reflect their operational cost and guarantee return on investment may not only be a better option at the moment but the only one necessary.

Unfortunately, that is not the kind of language and reasoning most Nigerians want to hear. As a consumer who relies on the networks even for my work, I am a victim of the adjustment too. But I am courageous enough to look at the bigger picture and empathize with the investors in the sector as much as I do the consumers. I am sure the National Communication Commission as the regulator may have had extreme difficulty in the balancing act of protecting consumers while evaluating the fears and contentions of the investors. I wish I had access to the NCC, I would have asked them a number of questions particularly concerning how they were able to navigate the complex balancing act required to approve a tariff adjustment at this point in time.

I am sure it has been a difficult decision to take. However these may not be the real reasons for my intervention though. At the risk of being labeled an apologist for officialdom, I make bold to say my intervention is prompted by the threat from the Nigerian labour Congress to hold a protest on the 4th of February 2025. I keep asking myself, when has the Labour movenment in Nigeria become so shallow and unitellectual in their operations to behave so unintelligently? An educated and well informed Labour movement would have adopted a more pragmatic approach to such issues. Their arguments would have been more robust beyond the narrow prisms of grand standing, attention seeking and empty rhetoric.

First of all before the Labour center intervenes, the affiliates grounded within the sector would have provided meaningful discussions on the subject matter. Recall how NUPENG and PENGASSAN used to educate Nigerians on the petroleum industry. What are the unions in the telecom sector saying? Why is NLC as the Labour Centre leading a protest without engaging the public on the real issues in contention. For example the last time a tariff adjustment was carried out in Nigeria was in 2013. That is more that a decade ago. What were the operational costs then and what is it today. As a mater of fact what were the dynamics of the telecommunications ecosystem then, and what is it now? For sure by 2013 data services were on the margins of the telecom operations. Internet penetration was low. Number of internet enabled devices were fewer. Smart devices were even far fewer. Number of subscribes were also lower than today. Reliance of some sectors like banking on the internet was equally lower than it is today. So how come labour or anyone will expect the telecom sector to freeze on a time frame when every other thing had gone up?

Let me start from the area that should concern Labour the most. In 2013 the minimum wage was 30 thousand Naira. Today it is 70 thousand Naira, more than double the amount in 2013. Other operational cost like the cost of fuel, value of the Naira in dollar terms and electricity tariff have all gone up. Will it not be unfair to expect the Telecom Industry to stagnate and not respond to these realities? I am not holding brief for them, but I believe that as private sector players if there is no return on their investment they may be forced to divest from the economy. After all we still remember that Econet, V-mobile and Etisalat have all divested from the sector. Will labour want that to happen? Or in the alternative will they rather the operators lay-off staff and scale down operations?

By the way, will the labour movement had kept quite if Telecom operators refuse to implement the minimum wage? Is it fair to ask someone to increase his operational cost without a corresponding fair increase in income? The telecommunication industry has become vital to the economic well being of the nation. So many other sector have grown to be dependent on the telecom services for both their functions and operational efficiency. The banking sector today will definitely suffer major setback without the back-up of the telecom sector. To that effect, the role of the telecom sector in job creation is beyond just its own industry. It is cross-cutting, involving practically all sectors of the economy. For example, apart from calls and data services, the POS operator in the remotest village will be jobless without data from the telecom operators.

In view of this, what the labour movement should have done is first to request its affiliates within the Telecom sector to dissect the dynamics of the sector in a manner that citizens will understand. How much in terms of costs goes into one minute of calls or one unit of data? How does it compare to the units charged as tariff? In doing so, let them take all variables into consideration. Take the transmission towers for example, almost all of them work on diesel powered generators. Each requires a minimum of three security personal on site at any point in time due to several factors particularly the raging insecurity in the country. Despite that, from time to time bandits and other miscreants attack and vandalize the towers and other installations. There are many other components and infrastructure that are required for the functioning of the sector which are absolutely essential. Unfortunately most of them are not available locally and must be acquired abroad using hard currencies whose value had gone up. Some of us are more inclined to express the genuine fear that if pushed too hard within an environment that is non-sustainable, investors in the sector may become too uncomfortable and be prompted to withdraw their investments and go elsewhere.

What organized labour and anyone genuinely concerned about the Telecom sector should be advocating for is an affordability template that respects value on investment. In such a situation the key factors required of the service provider after the tariff adjustment should be service efficiency. The operators must expand their facilities and improve access and quality of service. It is for this reason that the Labour Movement and indeed all patriots should demand that the Regulator must ensure that there is service efficiency across the whole country not just the urban centers. Since it is possible to monitor usage such as call time and cost on one’s personal devices, the regulator must also create a window for consumers to lay complaints through digital means in real time.

Nigerians need to extract assurances from the NCC that if complaints are escalated to them it will be attended to immediately. Let all tariffs be a function of service efficiency. Labour and indeed all Nigerians are to task NCC and Telecom Operators to provide tariff information and conditions affecting consumption patterns. That way consumers can easily manage their consumption patterns and extract maximum value for money spent. To that effect Labour should insist on the provision of enhanced infrastructure that will lead to growth and service provision to all undeserved areas. While investors in the sector are asking for cost reflective tariff system, consumers on the other hand should be demanding for value for money tariff system.

Realistically I would rather that the Labour Movement focuses on these issues rather than some ill-conceived protest that is just mere grandstanding. Over the years the current Labour Movement had been suffering from increasing erosion of public confidence in their antics. The Nigerian public is much wiser today. Come the 4th of February, labour leaders will come to realize that the scales have since fallen off the eyes of the gullible public. No one will join them on that misadventure, not even most of the workers. The reason is simply that painful as the tariff adjustment may be, the argument in its favour is more compelling to any rational mind. And if in the extreme, the Telecom Operators decide to divest from Nigeria, the consequences is better imagined than witnessed. On the planned protest of 4th February the NLC is riding a lame horse. The NCC acted in the best interest of Nigeria and Nigerians.

HUDU MUST FACE TRIAL AS COURT DISMISSES HIS APPLICATION

Adamawa State High Court sitting in Yola has dismissed an application filed by the suspended Resident Electoral Commissioner (REC), of the Independent National Electoral Commission (INEC), Barr. Hudu Yunusa Ari. News Platform

The application which was filed by Hudu, prayed Justice Benjamin Lawan Manji led high court to stay proceedings in the substantive case instituted by Adamawa State Government.

Hudu through his counsel, M. K. Tijjani, sought for an order of the court adjourning the case sine die pending the determination of appeal which was heard on the 21st January, 2025 and reserved for judgement by Yola Court of Appeal.

Tijjani argued that the decision whether or not to adjourn a case is at the discretion of the court, which discretion must be exercised judicially and judiciously considering the circumstances of the case.

He submitted that in the instant case, the applicant has appealed against the decision of the court on grounds of lack of jurisdiction and likelihood of bias in adjudicating over the case against him.

According to him, by Order 4 Rule 11(1) of the court of appeal rules, 2021, once an appeal is entered in the court of appeal, the appellate court becomes seized of all the proceedings as between the parties and that the court cannot share jurisdiction with the appellate court over the same case.

He further submitted that a judicial and judicious exercise of the discretion of the court demands that the proceedings before the court be adjourned so as to enable the higher court exercise full jurisdiction over the case.

On his part, Chief L. D. Nzadon, Counsel to the state, registered his opposition to the application by reliance on points of law alone made orally with leave of court.

Chief Nzadon, submitted that by the provision of section 307 of the Administration of Criminal Justice Law of Adamawa State, 2018 (ACJL) the court does not have the jurisdiction to entertain the applicant's application.

He concluded that all the cases cited by the applicant are civil cases and that not even one of the cases relied on by the applicant in urging the court to adjourn the matter sine die is a criminal case.

He told the court that based on the authorities cited by counsel to Hudu, the court lacks the jurisdiction to entertain the application and urged that the application be dismissed.

Ruling on the application, Justice Bejamin Lawan Manji, said that the grant or refusal of the application for stay of proceedings is a matter of discretion for the court to exercise judicially and judiciously.

Justice Benjamin held that it is incumbent upon the appellant/applicant to establish "beyond doubt" that the action ought not to go on.

He stated that counsel to the state is correct in his submission that the cases relied upon by Hudu to urge the court to stay proceedings are all civil cases and so only represent the general position of the law with regards to stay of proceedings in civil cases.

According to him, the matter before him is a criminal case and the rules of criminal procedure are not necessarily the same as those that apply in civil cases.

He stated that in view of the clear provision of section 307 of the ACJL, it is clear that there is no discretion available for the court to exercise.

Justice Benjamin Lawan Manji declared that the section clearly prohibits the court from entertaining an application that seeks to halt proceedings under any guise in a criminal matter and accordingly dismissed it.
