APC Kicks as PDP Moves to Rectify Error in Petition against ADHA Lawmaker



The ruling Peoples' Democratic Party (PDP) in Adamawa State has asked the Election Petition Tribunal sitting in Yola, to allow it amend major error in its petition against the Member representing Ganye Constituency at House of Assembly, Hon. Misa Musa. News Platform 


The party and its Candidate at the just concluded bye-election for Ganye Constituency Adamawa state House of Assembly, Hon. Buba Mohammed Joda, jointly filed petition dated 6th September, 2025, challenging the election of Hon. Misa of the APC.


In their relief 2 as contained in the petition, Hon. Joda and the PDP erroneously sought for an order of the tribunal directing the return of Hon. Misa Musa, 1st respondent as winner of the election instead of Hon. Joda, 1st petitioner.


It is against this backdrop that the petitioners in order to save their petition filed a motion on notice seeking for the amendment of particularly relief 2 considering how it has punched serious holes in the entire petition.


But in their reply, Hon. Misa and his party through their Counsels, Dr. Dayo Ashonibare Esq and Abubakar Ali Esq, conceded to the relief 2 of the petition.


According to them, they shall contend at the hearing of the petition that the relief 2 is meritorious and shall be granted by the tribunal.


Equally, the respondents have filed counter affidavit to the motion on notice brought by the petitioners on ground that the law does not allow amendment of relief or prayer in election matter.


On the other hand, the 1st respondent, has filed a motion on notice urging Justice A. O. Ebong, led tribunal to dismiss the petition on ground that it was instituted after 21 days statutory period.


He further urged the tribunal to dismiss the petition because according to him, there are no facts in support of the ground 2 of the petition and on ground that the reliefs sought are contradictory.


At the pre-hearing of the petition on Friday, the Chairman of the tribunal, Justice A. O. Ebong, adjourned the matter to the 30th October, 2025 for hearing of the pending applications.
