Hon. Auwal declared that he is the one running the affairs of the LGC in acting capacity as required by law, insisting that he has been performing his duty effectively without any hindrance.

In his further affidavit to the respondents counter claim dated 12th July, 2023, tendered before Adamawa State High Court, Hon. Auwal said that he is the acting Chairman, and that he has been acting in that position even after the judgement.

Hon. Auwal, who tendered his affidavit through his counsel, R. M. Agav, said that Hon. Hamidu and the Vice Chairman have not resumed as Chairman and Vice Chairman of the council, explaining that he is the person running the office till date.

However, in his counter affidavit opposing the applicant's motion for injunction, Hon. Hamidu Jingi Dirbishi, said that they have resumed their offices as Chairman and Vice Chairman respectively on the 16th June, 2023 and have been carrying out their duties as provided by law.

Hon. Hamidu through his counsel, A. A. Adam said that the counter claim was upheld and his removal and that of his vice from offices was declared illegal, null, void and of no consequence whatsoever.

The LGC was engulfed in leadership crisis following the alleged impeachment of Hon. Hamidu Adamu Jingi Dirbishi, by some councillors on the 25th May, 2023.

The councillors, who announced the removal of the Chairman, hurriedly sworn in the Leader of the Council, Mohammed Auwal Haruna, to serve as Acting Chairman of the LGC.

This led to litigation before the State High Court No. 7 presided by Justice, Ahmed Isa. In its judgement, the trial court invalidated the purported impeachment of Hon. Hamidu and his Vice.

Disastified with the judgment delivered on the 16th June, 2023, Hon. Auwal filed an appeal at the appellate court in Yola, seeking the nullification of the judgement of the lower court.

Having filed an appeal on the 17th June, 2023 as required by law, Hon. Auwal approached Justice Ahmed Isa led High Court where he filed a motion on notice for an injunction to stay the declaratory judgement of the court.

Delivering its ruling, the court presided by Justice Ahmed Isa, held that there were conflicts in parties' affidavits; hence, the need to call oral evidence to resolve the conflicts and adjourned the case to the 28th August, 2023.

On his appearance in court on Monday at the resumed sitting, Hon. Auwal told the court that he is processing the account of the LGC, saying that the fact the LGC is without the Secretary, it does not stop him from performing his duty.

Under cross examination, Hon. Auwal told the court that he had opened another office because the office of the Executive Chairman has been locked up by the security operatives.

He stated that he has never paid staff salary since assumption office as Acting Chairman, and that he had learnt that July Salaries were paid, but does not know who paid it.

After Hon. Mohammed Auwal's testimony, his counsel, R. M. Agav, urged the court to use the testimony of the applicant and resolve conflicts in the affidavits.

The matter was subsequently adjourned to the 11th September, 2023 for hearing of the respondents witnesses.
