The Federal High Court I sitting in Yola, Adamawa State on Friday, voided the election Hon. Ja'afar Abubakar Magaji, for Mubi North, Mubi South and Maiha federal constituency.
The court presided by Hon. Justice A. M. Anka, voided APC primary election which saw the incumbent member representing the constituency emerging the winner.
Anka, declared that the delegates who voted during the exercise were fake in clear violation of the electoral act, saying that the electoral act was breached by APC.
Justice Anka declined to order for fresh primary election in the federal constituency, saying that the party shall not field a candidate in the 2023 general election.
He ordered the Hon. Jaafar, to stop parading himself as the candidate and ordered INEC to disregard his name as APC candidate.
The court delivered judgement in suit filed by Hon. Jandani and former Chairman Maiha Local Government Council, Jibrilla Mohammed (Ustaz) and 4 other aspirants who participated in the exercise.
During the exercise held at Yadzara Cinema on the 27th May, 2022, the plaintiffs, Jibrilla Mohammed and Amina Kabir Mala scored zero votes, while, Mahmood Sali Yunusa got 1, Abubakar Umar Jarengol, 5 and Abubakar Sadiq Mana 9.
The plaintiffs asked the court to nullify the exercise, saying Hon. Ja'afar was not validly elected having failed to comply with accredition as contained in the guidelines for the nomination of candidates.
They sought for an order directing INEC to disregard and ignore the name, details, particulars of Ja'afar, submitted by the APC , and that the party be directed to organise fresh primary election for the plaintiffs and the 2nd defendant.
