JUST IN: COURT DISMISSES SUIT AGAINST YAPAK, ADHA LEGISLATOR




Federal High Court in Adamawa State on Friday, dismissed a suit instituted challenging the election of Hon. Abdullahi Umar Yapak, member representing Verre constituency at the House of Assembly.


Hon. Justice A. M. Anka, who dismissed the suit while delivering judgement on Friday, held that the action is incompetent and dismissed it accordingly.


The legislator who is seeking re-election for third term was declared winner of the APC primary election conducted on the 27th May, 2022. at Karlahi GDSS. 


But dissatisfied with the election, Hon. Nathaniel Hammarabe Yakim and Hon. Geoffrey Bulus Domgete who also contested for the seat, instituted an action challenging the exercise.


The aspirants joined APC, Hon. Abdullahi Umar Yapak and the Independent National Electoral Commission(INEC) as 1st, 2nd and 3rd defendants.


According to the plaintiffs, the exercise which was held at the Karlahi Government Day Secondary School on the 27th May, 2022 was marred by irregularities, and described it as invalid and unlawful.


The dou sought for an order of the court directing the party to withdraw certificate of return issued to Hon. Yapak, for him to contest for seat.


They prayed the court to issue an order restraining the party from forwarding Hon. Yapak's name to the electoral body as well as an order restraining him from parading himself as the candidate of the party.


Reacting on the judgement, the legislator described the verdict as a victory to democracy and to the entire constituency, and congratulated his constituents for the landslide victory.


Hon. Yapak, called on all the electorate in the constituency to rally round him in order to move the constituency forward, and specifically called on Hon. Nathaniel and Hon.Domgete to work together in the interest of Verre constituency.
