The Court of Appeal Yola Division on Thursday, set aside the judgement of the Federal High Court which voided the election of the Governorship Candidate of the All Progressives Congress (APC), Aishatu Dahiru Binani.
However, the court has upheld the candidature of Senator Binani, and ordered the party to forward her name to the electoral body ahead of the 2023 general election.
The three member of the appellate court headed by Hon. Justice Tani Yusuf Hassan, set aside the lower court's verdict while delivering judgement on the appeal instituted by Binani.
In a unanimous decision, the court allowed her appeal as sought and consequently set aside the lower court's judgement delivered on the 14th October, 2022, by Hon.Justice A. M. Anka.
Likewise, the appellate court has struck out the appeal brought before it by the embattled APC governorship aspirant, Mallam Nuhu Ribadu.
In his appeal, Ribadu, prayed the court to allow his appeal as well as order APC to conduct fresh governorship primary election to enable him participate.
But in its today's judgement, the court of appeal said it had heard the appeal challenging the trial court's decision and struck it out without any cost .
Similarly, the court of appeal has nullified the judgement of the trial court which barred the leading opposition party, APC from fielding a governorship candidate in the 2023 general election.
