COURT JAILS 1, DISCHARGES OTHER AFTER SPENDING 257 DAYS IN PRISON WITHOUT OFFENCE

The Chief Magistrate Court I in Yola, Adamawa State has discharged an 18 year old Abubakar Babangida after spending 257 days in prison custody.


Babangida of Unguwan Fulani in Vunoklang, Girei LGA had been in prison custody since 13th May, 2022, until Yesterday, where he ragained his freedom.


He was arraigned before the court for the offence of theft in a dwelling which contrary to section 279 of the penal code of law 2018, by the State Police Command.


The Police Command in its First Information Report tendered in court, said that the defendant was handed over to the Operatives of Crack Squad on the 23rd April, 2022 by members of Unguwan Fulani community.


While handing over the suspect to the police, the community alleged that Babangida and others(now at large) specialise in stealing phones and other valuables including money from their houses.


The FIR added that a distressed call was put to the police on the 23rd April, 2022, and that on moving to the scene, the police was handed over the suspect by the community.


The FIR could not indicate any item or amount of money stolen by the the accused as alleged by the residents in order to serve as an evidence before the court.


On his arraignment on the 13th May, 2022, the defendant pleaded not guilty to the alleged offence of theft in a dwelling house.


His case suffered series of adjournment until on Monday, when the Court presided by Chief Magistrate Mohammed Abubakar, discharged him.


Likewise, the court has convicted and sentenced a 22 year old Benjamin Lawi, to 12 months in prison for house breaking and theft.


Chief Magistrate Mohammed, sentenced him to 6 months in prison for house breaking as well as 6 months behind bars for theft and that the sentences are to run concurrently.


According to the presiding judge, the sentences will commence from the 14th July, 2022, the day of his remand at the Yola correctional centre.


Benjamin of Zaranda street in Jimeta, Yola North LGA was arrested on the 14th July, 2022 for allegedly stealing itel phone and acer laptop valued N10, 000 and N50, 000 respectively.


He broke into the compound of Liuda Peter, Hashimu Adams and Dorathy Lagira at Karewa Police Barracks and made away with the items contrary to sections 338 and 279 of PC.


He admitted committing the alleged offences when he was arraigned before the court by Inspector Zakka Musa.
