The Court of Appeal Yola Division has fixed the 3rd February, 2023 for judgement in suit instituted by the Speaker of the House of Assembly, Rt. Hon. Aminu Iya Abbas. NEWS PLATFORM can report.
The appellate court will also deliver judgement in 2 other appeals filed by Hon. Auwal D. Tukur against Ibrahim Mustapha and 3 others, as well that of Ibrahim Mustapha verses Rt. Hon. Iya Abbas and 3 others.
In his appeal, the Speaker has joined Ibrahim Mustapha, PDP, Independent National Electoral Commission(INEC) and Auwal D. Tukur, as 1st, 2nd, 3rd and 4th respondents.
The appellate court presided by Hon. Justice H. A. Abiru, after hearing the appeals on the 19th January, 2022, reserved same for judgement, and said that the date for judgement will be communicated to the parties.
Rt. Hon. Iya Abbas, was declared winner of the primary election conducted by the PDP, the exercise which was declared null and void by Hon. Justice A. M. Anka, of the Federal High Court.
His ticket was voided by the trial court on grounds of the participation of Auwal D. Tukur, in the race who did not resign his appointment as the Chairman Governing Council of the Adamawa State University(ADSU) Mubi.
