The Court of Appeal Yola Division on Monday, dismissed an appeal filed against Hon. Isa Yahya, Member representing Maiha constituency at the House of Assembly.
The appellate court affirmed the judgement of the Federal High Court delivered by Justice A. M. Anka, and dismissed the suit seeking to disqualify Hon. Yahya, from re-contesting.
Hon. Justice Anka, had on the 10th October, 2022, dismissed a suit instituted by an Aspirant for the House of Assembly seat, Hon. Mu'awiya Mahmud Dadi, alleging certificate forgery.
Hon. Mahmud of the All Progressives Congress (APC), had alleged that Hon.Yahya, is seeking re-election with a forged Secondary School Certificate.
He alleged that Hon. Yahya, the incumbent Member representing Maiha, who won APC primary, did not complete Government Secondary School Uba in Hong LGA, as he had claimed in an affidavit tendered in court.
He joined APC, Hon. Isa Yahya and the Independent National Electoral Commission(INEC) as 1st, 2nd and 3rd respondents in the suit instituted at the trial court.
Not satisfied with the decision of the trial court, Hon. Mu'awiya, through his counsel, E. O. Odo, approached the appellate court, and prayed it to invalidate the judgement.
Delivering judgement on Monday, Hon. Justice H. B. Abiru, described the appeal as a monumental failure and subsequently dismissed it in its entirety.
Hon. Abiru, ordered that the appellant shall deposit the sum of N400, 000 cash at the appeal court before considering appealing the matter at the apex court.
Reacting on the verdict, Counsels to the appellant and that of respondent, E. O. Odo and Abayomi Akamode, respectively, appreciated the court.
