MUBI/MAIHA APC TICKET: APPEAL COURT SLATES THURSDAY FOR JUDGEMENT




The Court of Appeal sitting Yola, Adamawa state has fixed the 2nd February, 2023 for judgement in suits for APC ticket Mubi North, Mubi South and Maiha Federal Constituency. NEWS PLATFORM 


The appeals were instituted by the incumbent Member representing Mubi North, Mubi South and Maiha at the House of Representatives, Hon. Ja'afar Magaji and Jibrilla Mohammed Jandani(Ustaz) respectively.


Hon. ja'afar, is battling to reclaim his ticket which was voided by the Federal High Court presided by Hon. Justice A. M. Anka, on the 25th November, 2022.


In his suit, the Federal Legislator asked the appeal coury to allow his appeal, set aside the judgment the lower court which invalidated his ticket.


Likewise, he sought for an order upholding the declaration that he is the winner of the APC primary election conducted on 27th May, 2022.


On his part, Jibrilla Jandani, whose suit caused Hon. Ja'afar ticket at the trial court, also appealed the judgement constesting the decision of the lower refusing to order for fresh primary.


He asked the appellate court to allow his appeal, set aside part of the judgement of the lower court refusing to order fresh primary election.


He prayed the court to order for fresh primary election so that APC can field a candidate in the February election.


According Jandani, the trial court's Judge erred in law leading to a miscarriage of justice when he granted reliefs not sought by either party before it by deciding that APC shall not field any candidate in the 2023 general elections.


He argued that none of the parties in the matter sought an order barring APC from fielding a candidate in the 2023 general elections as ordered by the Judge for the constituency.
