Adamawa Ministry, Urban Planning Dragged to Court for Land Conversion





The Ministry of Land and Survey as well as Urban and Regional Planning and Development Board in Adamawa state have been sued for allegedly converting plots of land belonging to 7 persons.


The plaintiffs, Pius Augustine Zira and 6 others, dragged the defendants/ respondents before Justice Kaynson Lawanson, led high for converting plots of land situated at Mayo-Inne Road, Army Barracks Road, Jimeta-Yola.


Pius and 6 others informed the court that they own houses and or property at the location, alleging that the defendants embarked on a massive conversion of the old road at plots of land which has been serving as access road to them.


The plaintiffs averred that by reason of the defendants converting and creating plots of land from the old and abandoned road, they have been denied access road to their property.


According to them, if the defendants are not restrained from their unlawful act, they would suffer hardship over and above other persons in accessing their houses and or property.


The plaintiffs said that they have made collective and individual approach to the defendants to re-consider and rescind their decision taking into account the hardship and inconveniences their decision will bring on them and their families but they have given it deaf ears.


When the case came up for mention during Monday proceedings, none of the defendants or their counsels was in court in spite of service.


Meanwhile, the Plaintiffs through their Counsel, O. B. Faison, has filed a motion on notice praying for an order of interlocutory injunction restraining the defendants/respondents, their agents, servants, privies or any person (s) connected to from further work on the plots of land in dispute.


The order is to restrain the defendants or any other person connected to them from trespassing, establishing beacons, building or doing anything capable of distorting the original or former road or access road/access road to the property of the plaintiffs pending the hearing and determination of the suit.


The court presided by the Justice Kaynson Lawanson has fixed 12th May, 2025 for ruling in motion on notice for and order to restrain the defendants.
