Man Drags Elder Brother to Yola Court for Using Army, Gangs to Attack Him



An Expert in Terrorism, Samaila Adamu Ziradzo PhD, has dragged his elder brother before Chief Magistrate Court 4 in Yola, Adamawa state for allegedly using Nigerian Army and Gangs to attack him.


The Complainant, Samaila of Karewa Extension in Yola, Adamawa state capital sued his elder brother, Yusuf Adamu Ziradzo, who resides at Karewa Masakare in Yola, Adamawa State.


In his direct criminal complaint pursuant to section 91 and 112 of the Adamawa State Administration of Criminal Justice Law 2018, the Complainant alleged that the defendant had on the 27th December, 2024 trespassed into his house at Tudun Wada Bazza in Michika LGA, which he had inherited from his late father and obstructed renovation work going at the site.


The Complainant aveered that he reported the matter at Michika Police Station, and that the DPO tried to settle the matter amicably, but that the defendant hid himself and refused to appear for settlement. 


He stated that the following day, the defendant blocked him in his car while on his way to Yola at Hong LGA and that his gangs near military checkpoint invited some soldiers that he (Complainant) is a criminal trying to run away.


He alleged that the military men arrested him and took him to unknown place, hanged him up, intimidated and tortured him as a result of which he sustained some injuries.


He added that the military men and his gangs beat him up and 3 other people in his vehicle including a 4-year girl and dragged everyone of them on the ground at gun point.


He said that the act of the defendant amounts to criminal trespass, assault, causing grievous hurt, wrong restraint contrary to sections 333, 340, 220, 231 and 232 of penal code law.


The case which was fixed for mention on Monday, could not proceed due to preliminary objection filed before the court by the defendant through his counsel, H. E. Turaso.


Addressing the court earlier, counsel to the complainant, M. B. Audu, said that they have received the PO and they intend to respond to it.


The presiding judge, Blessing Ishaya Dabari, held that the court shall hear and determine the PO before the substantive matter and adjourned the case to 27th May, 2025, for hearing on the PO.
