YOLA HIGH COURT SACKS GUYUK VILLAGE HEAD


  

The Village Head of Kerau Tudu in Kola District, Guyuk Local Government Area, Adamawa State, Malyam Habindi, has been sacked by a Yola High presided over by Honourable Justice Abdul-Azeez Waziri.


According to the Honourable Court, the purported selection of the embattled Royal Father has been  invalidated and set aside, and further restrained him from parading himself and performing the functions of the Village Head of Kerau.


The Court has further ordered the District Head of Kola, Mallam Hamman Alabura to forward the name of Jaranyala Samuel Hangiya for confirmation as the new Village Head of Kerau by Kwandi Nunguraya.


Jaranyala, according to the court, is the validly selected candidate for the stool having been so selected through due process as stipulated by the customs and tradition of the people of Kerau.


It further declared that it is the turn of the family of Kwankwawi of Bwantsaba/ Bakinbaraba clan to produce the next Village Head upon the demise of Baba Dan Zariya Kalabusi.


Trouble started over the stool when Malyam Habindi and the 1st defendant in the case started claiming and parading himself as the new Village Head in spite of the fact that it was not the turn of his clan to produce the king.


The embattled Malyam was said to be parading himself and performing the functions of the Village Head despite the fact that they were from the same Sambwaima clan with Baba Dan Zariya who died on the throne.


In protest to the action of the self acclaimed Village Head, Jaranyala, the 1st plaintiff and 2 others in the case went and took writ of summons and statement of complaint dated 26th June, 2018, and sought for a court order invalidating and setting aside the purported selection of the defendant.


He further asked the court to declare that the 1st Plaintiff was the duly selected candidate having been so selected through due process of the customs and tradition of the Village Head of Kerau.


He prayed for an order of perpetual injunction restraining the defendant from parading or performing the functions of the Village Head.


He told the Court that while himself belongs to Kwankwawi family of Bwantsaba/ Bakinbaraba clan expected to produce the new Village Head, the defendant does not, instead belongs to Sambwaima clan which produced late royal father.


In its judgement on the matter, the High Court presided over by Justice Abdul-Azeez Waziri, nullified the selection of Malyam Habindi, and ordered that Jaranyala Samuel Hangiya be confirmed as the new Village Head of Kerau.
