Gambo Nakura's Bail Application Suffers Setback as CP, Registrar File Preliminary Objection

The preliminary objection was filed by the Registrar Chief Magistrate Court II and the Commissioner of Police Adamawa State Police Command against the bail application filed by Gambo Nakura, through his Counsel, E. O. Odo Esq.
Gambo Nakura, who so far spent 13 days in prison custody for alleged multiple offences, had filed a motion on notice before the High Court presided by Justice Christopher Dominic Mapeo, praying the court to admit him bail.
When the matter came up for hearing on Tuesday, the respondents through their Counsel, J. A. Waya (DCL), informed the court that they had filed notice of preliminary objection dated 22nd September, 2025 as well as counter affidavit before the court.
In their preliminary objection, the respondents are challenging the jurisdiction to entertain the bail application because according to them, the applicant had already been admitted to bail by the Chief Magistrate Court II presided by M. A. Adamu.
After receiving the notice of the preliminary objection, the Applicant, through his Counsel, E. O. Odo, responded to the preliminary objection dated the 23th September, 2025.
Gambo Nakura appealed to the court to resolve all the issues raised by the respondents against them and dismiss the preliminary objection they had filed.
Addressing the court during proceedings on Tuesday, Counsel to the respondents, J. A. Waya, asked the court to adjourn the matter to enable respondents reply on points of law.
Responding, Counsel to the applicant, E. O. Odo, told the court that what is in the matter is the life of his client, saying that his client is sick and that the respondents will lose nothing if he is granted bail.
Odo argued that his client was granted bail by the Magistrate Court on impossible condition, saying that their concern is the health condition of the applicant in the prison custody, and that he should be granted bail to go and take care of himself.
Ruling, the court presided by Justice Christopher Dominic Mapeo, adjourned the case to Wednesday 24th September, 2025 to enable the respondents reply on points of law and for hearing of preliminary objection.
