Motion Exparte Stalls Hearing as Gambo Nakura Cries ill Health in Prison Custody
The scheduled hearing in the case filed against the Chairman Concerned Citizens Adamawa state, Alh. Husseini Bello Gambo Nakura, was on Wednesday, stalled due to his motion exparte filed before Yola High Court. News Platform
The hearing in the case was fixed for Wednesday, by the Chief Magistrate Court II sitting in Yola, Adamawa state where Gambo Nakura was arraigned for multiple offences.
The matter which was to be heard today, was stalled due to the motion exparte filed before Yola High Court presided by Justice Christopher Dominic Mapeo by the defendant himself.
In his motion exparte dated the 12th September, 2025, the defendant through his Counsel, E. O. Odo, prayed for an order of the court quashing the proceedings of the magistrate court in case no CMCY/632cc/2025.
Equally, he sought for an order directing the transfer of the case to any other court of competent jurisdiction for adjudication as well as an order admitting him to bail pending the trial before the court which the matter is transferred.
Likewise, in his further and better affividat filed before the High Court, the defendant through his Counsel, E. O. Odo, prayed the court to admit him to bail and cited health condition as grounds to his motion.
Already, the high court has fixed the 23th September, 2025 for hearing in the motion on notice which has since been served on the Registrar Magistrate Court and the Commissioner of Police Adamawa State.
It could be recalled that Magistrate M. A. Adamu, had last week admitted the defendant to bail, but could not fulfill his bail condition; hence, his remand at Yolde Pate Correctional Centre.
Gambo Nakura has been in prison custody since 10th September, 2025, for alleged offences of defamation of character, use of insulting and abusive language, disturbance of public peace and inciting disturbance contrary to sections 378, 379, 385 and 80 of the penal code law Adamawa state.
