COURT REVOKES BAIL...REMANDS ADAMAWA COUNCILLOR, WARD HEAD IN PRISON

Magistrate Court II in Yola, Adamawa State on Monday revoked the bail granted to Hon. Paul Danladi, Councillor representing Modire Ward in Girei Local Government Area and Zira Garba Masi, Ward Head who are facing trial before the court.

Magistrate Japhet Ibrahim Basani, revoked the bail on grounds that after the court graciously granted bail to the defendants, they went and started interfering and threatening the lives of some of the complainants involved in the matter.

Hon. Paul, Garba Masi and the Village Head of Modire, Mohammed Bello Modibbo, were nabbed by the Department of Security Service(DSS) over alleged criminal conspiracy, intimidation, treespass and mischief lodged by 19 people including a Surveyor Ministry for Land and Survey and erstwhile Permanent Secretary in the state.

The trio who were detent by the DSS for 12 days and later arraigned before the court on the 18th June, 2021 by the operatives of the department through the office of the Attorney General and Commissioner for Justice, and subsequently granted bail following an application by their Counsel, Mohammed Abubakar.

While ruling on the bail application, the presiding Judge granted bail to the defendants and warned them to desist forthwith from interfering in the disputed land pending the determination of the matter and adjourned the case for hearing.

But while testifying in court today, one of the prosecution witnesses, Gambo Aiden Heriju, informed the court that after the 3 defendants were granted bail, the 2nd defendant(Gambo Masi) met his wife and threatened to mobilise people to kill him.

Heriju told the court the 1st and 2nd defendants were still interfering in the disputed land even when the matter is still pending before the court, saying that he is afraid that his life is danger.

It was at this juncture that the Counsel to the prosecution, M. A. Adamu, applied that the bail granted to the Honourable Councillor and the Ward Head be revoked since they deliberated refuse to obey the order of the court.

M. A. Adamu, further applied that another witness, Linus Yerima, be brought to court to corroborate the testimony of the witness who earlier told the court that the Councillor and the Royal Father have been tempering with the disputed land and threatening the lives of the complainants.

On their part, Counsels to 1st defendant, Mohammed Abubakar and that of the 2nd and 3rd defendants, M. P. Dangi, urged the court to refuse the application and prayed it to give them time to appropriately respond to the bail application.

In his ruling, Magistrate Japhet Ibrahim Basani, revoked the bail granted to the 2 defendants and ordered that the defendants be remanded at Yola correctional service facility and further adjourned the matter to 14th July, 2021 for continuation of hearing.
