A 35 year old man, Habila Luka of Mamurla village in Mubi South Local Government Area, Adamawa state has been arrainged before state High for allegedly stealing and strangulating his neighbour, Jauro Manda Kapuwa to death.
Habila and father of 2 has been charged to court on 2 count charges bordering culpable homicide contrary to section 191 (a) and punishable under section 192 (a) of the state penal code law.
When he was arraigned before the court on Thursday, the accused person pleaded not guilty to the alleged offence after which the prosecution counsel, M. B. Rufai, pleaded with the presiding judge, Helen N. Hammanjoda, to adjourn the case to enable him assemble witnesses and exhibits to prove his case.
According to the particulars of offence, the defendant stormed the residence of the deceased in the night and strangulated him with the intention of causing his death.
But in his exra judicial confessional statement, the defendant confessed that the deceased accused him of stealing his money as a result of which he hired the services of a native doctor so as to use traditional method in order to identify who stole the money.
According to him, the native doctor made use of a broom, and that the broom caught him as the one who stole the money even when he was not physically present at the place.
Habila stated that anytime the broom catches someone, it means he was the one who committed the alleged offence, saying that he was working in his farm when the broom caught him.
He averred that as soon as the native doctor finished his consultations, the deceased concluded that he was his thief and threatened to kill him.
The defendant stated further that the victim told him that he will no longer live for one week, and that he should put his house in order because he is going to die, stating that he knew very well that the deceased meant it and will kill him.
In his response, Habila said that he told Kapuwa that he (Habila) will be the first person to terminate his life before he kills him, saying that on that fateful day, himself and 2 of his friends went to the man's house while asleep and strangulated him to death and was later arrested in connection to the incidence.
When the matter came up for mention, the accused person denied committing the offence after which the court adjourned the case to the 28th October, 2021 for commencement of hearing.
