CRIMINAL BREACH OF TRUST: COURT STRIKES OUT CASE AGAINST EX- DUMNE ADMINISTRATOR
Yola Upper Area Court III in Adamawa state has struck out a case of criminal breach of trust and cheating against the erstwhile Administrator Dumne State Development Area, Hon. Padio Amos Sunday.
The former Administrator was earlier dragged to the court by one Alhaji Umar Abdullahi who was contracted to supply 50 trips of laterite for the rehabilitation of Loko -Dumne road.
The ex- Administrator and younger brother to the Head of Civil Service of the state, Dr. Edgar Sunday Amos, awarded the contract in his capacity as the Administrator of the Development Area.
Hon. Padio engaged the services of the complainant to supply the laterite at the cost of #200,000 which the complainant supplied but only #110,000 was given to him as part payment.
But at its resume sitting today, the Court presided by Hon. Umar Isa, struck out the case as a result of failure of the complainant and his counsel to appear in court.
Hon. Umar dismissed the case based on the application filed by the counsel to the respondent, MB Abdullahi Ribadu where he cited section 352 (2) of Adamawa State Criminal Justice Law which stipulates that the court may strike out a case if the complainant fails to appear in without any reason.
Earlier, the court ruled that the complainant has the right to institute legal action against the defendant.
