ADAMAWA: TRIBUNAL SACKS APC COUNCILLOR, ORDERS FRESH ELECTION




Local Government Election Petition Tribunal sitting in Yola, Adamawa State, on Tuesday, nullified the election of Mustafa Bashir, Councillor representing Toungo ward in Yola South LGA.


The Tribunal however ordered the State Independent Electoral Commission (ADSIEC) to conduct fresh election in the ward within a reasonable time. 


Bashir who won election held on the 9th April, 2022 under the All Progressives Congress(APC), was dragged before the Tribunal by the PDP Candidate, Abubakar Muktar. 


Muktar along side PDP, joined Bashir, APC and ADSIEC as 1st, 2nd and 3rd respondents in a petition dated 22nd April, 2022, and prayed the Tribunal to declare  Bashir's election null and void.


In his petition, Muktar, informed the Tribunal that the Respondent was not screened by the Screening Committee constituted by ADSIEC as required by the State Electoral Law 2002 and the 2022 election procedures.


While delivering its judgement on the matter, the Chairman of the Tribunal, Hon. Aliyu Bello Isa, nullified the election and ordered for fresh exercise.


Hon. declared that the report of the Screening Committee of all political parties constituted by ADSIEC was not duly sign by the Chairman of the Committee.


During the sitting, El-Kabir Auwal appeared for the Petitioner, while N. I. El-Yakub and Ibrahim Saidu, appeared for the 1st, 2nd and 3rd Respondents respectiverly.


Speaking to NEWS PLATFORM shortly after the judgement, Counsel to the 1st and 2nd Respondents, N. I. El-Yakub, appreciated the Tribunal for its time and wisdom and vowed to appeal the decision.
