Former Chairman Maiha Local Government Council, Jibrilla Mohammed (Ustaz) and 4 other Aspirants in the just concluded primary election for Mubi North, South and Maiha, federal constituency have dragged APC to court for scoring them zero votes.
The APC primary election for the constituency saw the emergence of the incumbent, Ja'afar Abubakar Magaji, as winner after scoring a 103 out of 125 votes cast. NEWS PLATFORM recalled.
During the exercise held at Yadzara Cinema on the 25th May, 2022, the plaintiffs, Jibrilla Mohammed and Amina Kabir Mala scored zero votes, while, Mahmood Sali Yunusa got 1, Abubakar Umar Jarengol, 5 and Abubakar Sadiq Mana 9.
But the plaintiffs through their counsel, D.K. Rigange, approached the Federal High Court sitting in Yola and asked it to nullify the exercise, saying Ja'afar was not validly elected having failed to comply with accredition as contained in the guidelines for the nomination of candidates.
They sought for an order directing INEC to disregard and ignore the name, details, particulars of Ja'afar, submitted by the APC , and that the party be directed to organise fresh primary election for the plaintiffs and the 2nd defendant.
But in its motion on notice, the party through its counsel, D. S. Adebole, urged the court presided by A. M. Anka, to extend/enlarge the time within which his client (1st defendant) may file and serve its counter affidavit in opposition to originating summons.
He informed the court that the delay in filing their counter affidavit is not intentional or deliberate, saying they needed time to regularise their processes.
The presiding judge, A. M. Anka, adjourned the matter to the 29th August, 2022 for hearing.
