Governor Ahmadu Umaru Fintiri, Independent National Electoral Commission (INEC) as well as the PDP have asked the Election Petitions Tribunal to dismiss petition filed by Aishatu Dahiru Binani. News Platform
The tribunal on Friday heard that Binani, APC Governorship Candidate in 2023 election, filed application for pre-hearing on the 15th instead of 19th June, 2023 after the closure of all pleadings.
The tribunal also heard that Binani's petition is an abandoned petition because there is no competent application for pre- hearing to activate it.
It is against this backdrop that Fintiri, INEC and PDP urged the tribunal to strike out the application which according to them was filed prematurely.
According to them, Binani's application is not only prematurely but invalid, null and void and ought to be struck out and therefore the petition is dead on arrival.
In his motion on notice challenging Binani's application, Counsel to Fintiri, D.D. Dodo, said Binani's petition is an abandoned one for failure to adhere to the electoral act's provision for pre-hearing.
Similarly, Counsels to INEC and PDP, Nuremi Jimoh and Yakubu Maikasuwa argued that Binani's application was filed prematurely and ought to be dismissed.
Responding, Counsel to Binani and APC, Sam Olugunorisha, urged the tribunal to dismiss all the applications challenging his clients application for pre-hearing, saying that it is the filing of process that determines the closure of pleadings.
The ruling was reserved in all the applications.
