The Senator Adamawa Central Senatorial District, Aminu Iya Abbas has urged the National Assembly Petitions Tribunal to dismiss petition filed against him by erstwhile Senator Abdul-Aziz Nyako. News Platform
Senator Iya Abbas, asked the tribunal to dismiss the suit instituted against him while adopting his final written address on Monday at the resumed sitting of the tribunal in Yola.
The petitioner and the former Sen. Abdul-Aziz Nyako of the APC sued Iya Abbas who clinched the senatorial ticket under the platform of the PDP.
Already, the three man tribunal has reserved the judgement in suit, and said that the date will be communicated to the parties involved in the matter.
In a motion on notice filed on the 14th May, 2023, Senator Iya Abbas urged the tribunal to dismiss the petition for being an abuse of court process, incompetent as well as for lack of jurisdiction.
Sen. Abbas through his counsel, M. A. Magaji (SAN) who was represented by Abubakar Saad (esq) also asked the tribunal to strike out pages 13 to 38 of the petition for it was predicted on pre -election matters?
He equally prayed it to dismiss the petition in its entirety for lack of locus standi and for being statute barred.
Adopting his final written address filed on the 16th June, 2023, Sen. Iya Abbas distilled 3 issues for determination and adopted same as his argument in opposition to the petition.
Likewise, counsel to PDP, A. J. Akamode filed their written address on the 16th June, 2023 and adopted it while praying the tribunal to dismiss the petition in its entirety.
On his part, counsel to the petitioners( Sen. Abdul-Aziz and APC), M. S. Ibrahim(SAN) adopted their written address filed on the 20th June, 2023 and urged the tribunal to allow the petition and grant all the relifs sought with a cost.
