The Chief Magistrate Court II sitting in Yola, Adamawa State on Tuesday, remanded a house wife along side her husband in prison custody for criminal conspiracy and cruelty to persons"
The court remanded Fatima Abubakar, 37, of Sanda Makama B ward and her husband Abubakar Yuguda, 54, of Galadima Faruk street in Yola South LGA for the offences.
Fatima, landed at the correctional center for wilfully maltreating Usman Abubakar, 3-year old and her sister, Hafsat Abubakar, 2-year-old respectively.
The 1st defenadant is the step-mother to the kids, while Yuguda is the biological father of the children who had divorced their mother after marrying Fatima.
Yuguda goes to prison for his failure to assume his full responsibility as father and how he had condoned or abetted the excesses of his wife and for neglecting the children at the mercy of their step-mother.
The couple were arraigned before Magistrate M. A. Adamu, for the offences which contravened sections 60 and 209 of the Penal Code Law, Adamawa State.
On their arraigning, the 1st defendant and barren house wife pleaded guilty to the alleged offences, while the 2nd defendant pleaded not guilty.
After the plea of the defendants, the Prosecuting Police Officer, Asp Iliya Akawu, who arraigned them in court on behalf of the Commissioner of Police, CP Morris Dankombo, prayed the court to adjourn the case.
Shortly after the case was mentioned , M. M. Umar, who appeared for the defendants, applied for the bail of the defendants, saying that the defendants have reliable sureties to stand for them and that they will not jump bail.
According to him, the offences are bailable in nature even though the bail is at the discretion of the court and urged the judge to admit them to bail on most liberal terms.
Responding, ASP Akawu, vehemently opposed the bail application, saying that the offences are not ordinarily bailable and that the victims are still on admission at a medical facility based on the severity of the injuries sustained.
He said that the police and the medical team are still following up and monitoring the health condition of the victims, saying that the first defendant had since pleaded guilty, and urged the court to refuse it.
He pleaded with the court to remand the defendants and adjourn the matter to enable him call witnesses to corroborate 1st defendant's guilt plea as well as establish his case against 2nd defendant.
Ruling on the bail application, Magistrate M. A. Adamu, said that the bail is the constitutional right of every citizens, saying that in the case at hand, the act has been in public glare.
He refused to admit the defendants to bail and adjourned the matter to the 21st October, 2024 for corroboration of plea of guilty entered by the 1st defendant and to commence hearing on the 2nd defendant.
