Breaking: Appeal Court Rejects Hudu's Plea to Strike out Case



Appeal Court Yola Division has dismissed an appeal filed by the sacked Resident Electoral Commissioner of the Independent National Electoral Commission (INEC), Barr. Hudu Yunusa Ari. News Platform 


The appellate court affirmed the ruling of Yola High Court presided by Justice Benjamin Lawan Manji, delivered on 9th July, 2024, and dismissed Hudu's appeal in its entirety for lacking in merit.


Hon. Justice P. A. Mahmoud, of the court of appeal also refused to grant his relief to strike out charges filed against him by the Adamawa state government, insisting that Hudu must be arraigned before High Court to face trial.


Likewise, the appellate court declined to grant Hudu's relief for an order setting aside the warrant of arrest issued against him by Justice Lawan Manji on the 15th May, 2025.


In his appeal against the ruling of Justice Lawan Manji, Hudu, asked the appellate court to allow his appeal and set aside the warrant of arrest issued against him as well as strike out charges filed against him by the government.


Hudu described the the complainant/ respondent's charges against him as unconstitutional, unlawful, null and void and constituting an abuse of court process. 


He informed the appellate court that Justice Lawan Manji issued warrant of arrest against him without being served with any charge requiring him to appear before the court to answer some alleged offences brought against him.
