Counsels to the embattled Chairman of the All Progressives Congress(APC), Adamawa State chapter, Alhaji Ibrahim Bilal, have disclosed that their Client has not resigned his position as APC Chairman Adamawa state.
There was a letter over the weekend dated 13th September, 2022 and addressed to the National Chairman through the office of the National Vice Chairman Northeast Zone, indicating that Bilal, had resigned his position.
But reacting on the letter, Lead Counsel to the embattled Chairman, Ever Odo, told NEWS PLATFORM on Monady, that their Client is very much in his office, and that the court has been protecting his seat.
He disclosed thus: "To the best of our knowledge as lawyers representing him in this matter, we are not aware of his resignation. He has not resigned, and he is still the APC Chairman Adamawa State".
"It is also interesting that all the lawyers representing all the Defendants in this matter have appeared in court today. The matter has been adjourned for hearing proper, and the court order restraining anybody from tempering with his seat is still in force", Odo added.
"As far we are concerned, there is no problem at all. Our plaintiff in this matter has not resigned, and he is pursuing his case to a logical conclusion", he stated.
Odo, noted that if he was the one that signed the letter, he would have informed them to withdraw their appearance for him so that the matter will end.
According to him, it is easy for somebody to scan a signature and put it on a document, saying that such signature will look as if it was the owner who had signed it.
Meanwhile, the Adamawa State High Court of Justice presided by Hon. Justice Musa Usman, has fixed the 23rd September, 2022 for hearing in the suit instituted by Bilal.
Bilal has sued Samaila Tadawus, the new APC Chairman and 14 others to court contesting his removal from office.
NEWS PLATFORM gathered the embattled Chairman is seeking 8 reliffs among which an order nullifying his purported removal from office by Tadawus(1st Defendant) and 14 others.
He prayed the court to declare that in view of the provision of section 36 of the 1999 Constitution and Article 21.1 of the APC constitution, the 1st to 14 Defendants cannot validly issue a notice of complaint against him(Bilal) and also unilaterally decide his fate over the same complaint by removing him from office without following the procedure provided by Article 21.3 of APC's Constitution.
Further more, he urged the court to declare that by the virtue of the provision of the Article 13.8, 13.9 and 21.3(a) and (b) of the APC Constitution, the 1st to 14 Defendants have no powers to discipline and purportedly remove him from office.
He also asked the court to declare that the notice of complaint dated 26th August, 2022, addressed to the him by the 1st to 14 Defendants is not a competent notice of complaint to proper authority having regard to the provision of APC constitution.
While urging the court to order all the Defendants to pay him the whooping N1billion as general damages, Bilal, sought for an order to of perpetual injunction restraining the Defendants from taking any step against him that is not in accordance with the procedures laid down by APC constitution as well as the 1999 constitution.
The Lead Counsel, Ever Odo, appeared in court on Monday, for Ibrahim Bilal along side Aji Kamale (Wazirin Garta), and Hassan Maidawa, while A. A. Jatau and Idriss Shuaibu, appeared for all the Defendants.
