JUST IN: HON. DEPOLIS WINS AS COURT REFUSES TO NULLIFY HIS REPS ELECTION




The Federal High Court II sitting in Yola, Adamawa State on Friday, declined to nullify the primary election of the All Progressives Congress (APC) which produced Hon. Joseph Ayuba Kwada(Depolis) as the candidate for Michika/Madagali Federal constituency.


Hon. Justice S. I. Kogo, refused to nullify the election while his delivering judgement in suit instituted by an Aspirant, Anna Sini, who also contested for the seat in the just concluded primary election.


The judge declined to grant all the reliffs sought by the female politician and upheld the election, saying that the exercise conducted by APC for Michika/Madagali, was in compliance with the provision of the law.


According to him, Hon. Depolis was duly screened and cleared by the Screening Committee of the party; hence, his participation in the exercise.


Anna, had dragged Hon. Depolis and APC to court where she asked the court to nullify his election as his contest had violated the provision of the Constitution of the Federal Republic of Nigeria 1999, the electoral act and the guidelines for the nomination of APC candidates.


She prayed for the court's order declaring her as the duly elected Candidate of the APC for the constituency having secured highest number of lawful votes during the exercise.


While reacting on the judgement, Counsel to Hon. Depolis, M. C. Chijoke, and that of Plaintiff, Ever Odo, respectively, appreciated the court for the decision.
