Adamawa State High Court of Justice, on Thursday, ordered for substituted service on 8 officials of the All Progressives Congress (APC) in the state.
The affected State Exco include; Mustapha Atiku Ribudu, Organising Secretary, Idriss Shuaibu, Legal Adviser, Saidu Maitalata Naira, Ex-Officio II, and Abubakar Abubakar, Youth Leader.
Others are; Audu Monday, Welfare Secretary, Usman Hamalai, Senate Youth Leader, Idriss Abubakar, Assistant Youth Leader and Obed Shadrack, Auditor.
Issuing an order, Justice Musa Usman, said that the court had carefully considered the application, its grounds and affividat in support of the application.
He said that the court is satisfied with the application as it is meritorious and ought to be granted and same is accordingly granted, and however ordered that all processes be pasted at the APC State Secretariat
Justice Musa Usman, however adjourned the matter to the 19th September, 2022 for hearing of the motion on notice.
The motion ex-parte was brought before the court by Ever Odo, Aji Kamale(Wazirin Garta), Hassan Maidawa and A.S Augustine, Counsels to the Plaintiff, Alh. Ibrahim Bilal.
The motion ex-parte dated and filed on the 14th September, 2022, prayed for an order of the court to allow substituted service of all the processes on all the defendants.
NEWS PLATFORM recalls that Bilal in suit marked: HC/ADSY/143/2022, has joined Samaila Tadawus, APC and 13 others contending his purported removal from office.
Speaking to NEWS PLATFORM shortly after the sitting, Lead Counsel to Bilal, Ever Odo, explained that they approached the court for an interim order to effect service of processes on some of the Defendants who appear to have been evading service.
Odo added that the court had granted an order to effect the service, and that they will serve them appropriately because they want the matter to continue and be determined best on its merit.
According to him, their Client was elected in accordance with APC Constitution for a term of 4 years, and that he has the right to occupy the office for that period of time.
He said that removing him from office must be strictly in accordance with the same Constitution under which he was elected which is also binding on all APC members.
He added that by the Constitution of APC, the Exco is made up of close to 100 people: 36 elected members, all the Chairmen and Secretaries of the 21 LGAs, former Governors and their Deputies.
He alleged that only 14 people who sat and took a decision in the early hours when normal human beings were sleeping without the knowledge of other exco.
