TRIBUNAL KNOCKS OUT KEFAS CALVIN, AFFIRMS UMAR NYAKO



Member representing Toungo constituency at the Adamawa State Houseb of Assembly under the platform of All Progressives Congress(APC), Hon. Abdullahi Umar Nyako, has finally nailed  the coffin of his Peoples Democratic Party(PDP) opponent, Hon. Kefas Calvin, as the Election Petition Tribunal has today ratified his election as winner of the  House of Assembly seat representing Toungo.

The Tribunal sitting in Yola had while delivering judgement on a petition filed by the embattled PDP candidate, said the suit against Hon. Nyako, lacked merits and cannot stand any lawful justification.

Hon. Kefas, told the court that the election of Hon. Nyako, was characterised by bribery, alteration of result sheet, vote buying, over voting, non accreditation of voters which according to him outrightly violated sections of the Electoral Act, explaining that the exercise was not carried out in compliance with the electoral law and that it should be set aside.

He prayed the court to declare the election of the member as invalid on grounds that the incumbent was not elected by the majority of the voters in the constituency, urging the court to declare him(Kefas) as the winner of the election, and should order the electoral body to issue him with the certificate of return.

But on his part, Hon. Nyako asked the court to discountenance all the allgations in its entire for lack of merit, arguing that the petitioner had failed in substantiating his suit with concrete evidence to determine the case in his favour.

In his ruling, the Chairman of the Tribunal Justice, Suleiman Akanbi, who was assisted by two other justices, quashed the petition for lack of merit.

The Tribunal held that the petitioner could not adduce concrete evidence in support of his case, and however struck it out in its entirety for the inability of the complainant to convince the Tribunal.
