An Upper Area Court 3 in Yola, Adamawa State has described as untrue, false and misdirection of facts, a recent media publication that a case file slated for judgment on rape case against one Mohammed Aliyu was missing from the court.
In a statement made available to newsmen by the court, said at no time did the court entertain any case of rape as it is not within its its jurisdiction rather a case before it was that of indecent assault.
The Court further described the report as a calculated attempt by mischief makers to tarnish the image of the court of law, saying that there was no time in the court that a file was reported missing, thereby dismissing the reports in its entirety.
According to the Court, no case file ever disappeared and that all the files that are ready for judgment are under the custody of the registry, insisting that the so called journalists out of desperation decided portray the court in bad light.
It added that the case which was reported as "rape case" is not true, instead is it the case of alleged " Act of Gross Indecency" with file number Y/12/c3/2018/ involving one Mohammed Aliyu, saying that even on the First Information Report (FIR) it is stated: " Act of Gross Indecency" and not rape case as reported.
It described as unfortunate a situation whereby some so called journalists who do not have knowledge of legal terms and proceedings will be misrepresenting the court in their reportage.
Henceforth, according to the Court, any reporter who disseminate false report on its proceedings will be charged for contempt of Court, saying any reporter who knows his or her onions will cross check his facts before publication.
Reacting on the report, the Registrar of the Upper Area Court, Barrister Aminu Sule said that the case file was with the registry and that judgement was not ready at that time and not missing as reported.
Barr. Sule said it is the duty of a registrar to keep all files that are ready for judgment and not the Judge, explaining that ordinarily Area Courts and Upper Area Courts do not have jurisdiction to try rape cases.
Barr. Sule disclosed that the case was slated for 14th January, 2020 for judgment and not 4th January, as contained in the reports.
