Demsawo Area Court sitting in Yola, the Adamawa State has dissolved a one year and nine months old marriage between Fatima Usman and Ali Shuaibu with the sum of #75,000.
According to the court, the money will be paid by Fatima Usman to her husband, Ali Shuaibu as Khuli, so as to free herself and to enable the husband marry another wife.
The court put a knife into the marriage following the case filed before it by Fatima, seeking for dissolution of the marriage based on Khuli, and as provided by Islamic injunction.
In suit number CV/ 135/2019/, the Plaintiff earlier on told the Court that they got married for 1 year and 9 months without an issue.
She said that soon after their marriage with 3 months, her husband started beating her, abusing her parents and accusing her of infidelity.
She told the court that she had lost confidence in staying with the defendant as husband and wife and prayed the court to separate the marriage based on Khuli.
But when the case was mentioned at a later date, the husband denied all the allegations levelled against him by his wife.
On the prayers of the wife for dissolution of the marriage, the husband objected to it and told the Honourable Court that he still loves his wife and pleaded for out of court settlement.
But at a resumed sitting of the court, the couple informed the court that they could not come to terms, thereby forcing the court to put an end to the marriage.
Delivering his judgement, Magistrate Abdullahi Mohammed Digil ordered the wife to pay the sum of #75,000 out of#150,000 earlier requested by the husband so as end the marriage.
The Court declared that Fatima still remains the wife of Ali pending the time she gives her husband the money, saying that anytime she pays the money, it marks the end of their marriage.
