APPEAL COURT OKAYS 14 DAYS FOR FINTIRI TO FILE APPEAL AGAINST 659 TEACHERS



The Court of Appeal sitting in Yola, Adamawa state has given 14 days to the state government to file notice of appeal against the judgement of the National Industrial Court, Yola.


Justice Chidi Nwaoma Uwa, the presiding judge of the court on Tuesday, allocated 14 days to the government to file notice of appeal against the verdict of the Industrial court which ordered for the payment of N660 million to the embattled Batch D1 Teachers.


The lower court had on the 13th June, 2018, ordered the government to pay 659 teachers sacked by the Post Primary Management Board, after they were said to have worked for a period of 29 months.


The teachers known as Batch D1 were part of those recruited in 2012 before the government declared their employment by the Post Primary Schools Management Board illegal.


It could recalled that the teachers joined the State government, Ministry of Education, PPSMB and the Attorney General and Commissioner for Justice as 1st, 2nd, 3rd and 4th respondents in their suit before the Industrial court.


Not satisfied with the decision of the Industrial court, the government filed notice of appeal on the 30th July, 2018, with a view to challenging the judgement.


The government also filed a motion on the 31st March, 2021, to seek for leave to appeal the lower court's verdict out of time.


Ruling on the motion, Justice Uwa, granted the application and given it 14 days within which to file its appeal.


While I. B. Suleiman (Senior State Council 2) appeared for the applicants, M. P. Atsev, who held the brief of J. T. Damsa, appeared for the resdpondents.


Speaking to NEWS PLATFORM shortly after the ruling, counsel to applicants, I. B. Suleiman, said he was happy that the court has granted their application, saying that they have been given opportunity to ventilate their grievances.
