BREAKING: COURT RESTRAINS APC FROM CONDUCTING CONGRESS IN MUBI SOUTH



Adamawa State High Court sitting in Yola, on Friday restrained the All Progressives Congress (APC) state chapter from conducting congress scheduled for Saturday 4th September, 2021 in Mubi South Local Government Area.


Justice Kanyson S. Lawanson, of the State High granted an order of interim injuction restraining the party and its leadership from conducting the Chairmanship and other exco for Mubi South LGA pendering the hearing of the motion on notice.


The presiding judge further adjourned the suit to the 7th September, 2021, for hearing of the motion on notice.



Earlier, one of the Contestants for Chairmanship of Mubi South LGA under the platform of APC, Barrister Idris Shuaibu, approached the court and urged it to bar the party from conducting the scheduled exercise in the LGA.


Barrister Idris, had joined APC, Alhaji Ibrahim Bilal who is also the APC Chairman in the state, Alhaji Njobdi Sale Kwaja, APC Chairman Mubi South LGA and Mohammed Bobboi, Secretary APC Mubi South LGA as 1st, 2nd, 3rd and 4th defendants/respondernts in the suit.


The Plaintiff/Applicant held that it is unlawful for the incumbent Chairman and Secretary of the party in Mubi South who are also candidates for Chairmanship of the party to organise tomorrow's exercise as well as determine the venue where the event will hold.


Barrister Idris, insisted that it is not unlawful for the party in the LGA for the purpose of electing Chairman and other exco for Mubi South to schedule and hold election in 2 separate venues simultaneously at the instance of two.


According to him, as a Financial Member of the party in Kwaja ward who is also contesting election into the office of APC Chairman Mubi South LGA, he is at the cross road and does not know where to fall.


He told NEWS PLATFORM that the incumbent Chairman had issued a letter indicating that the exercise will hold at Lamurde Secondary School by 8:00am, while the Secretary issued his own letter which shows that his own exercise will hold at the party secretariat by 10:00am respectively. 


The Legal Practitioner argued that he has no alternative than to approach the court so as to restrain the party and its leadership from acting contrary to the provisions of the law.


 But when the bailiff of the High Court stormed the State Secretariat of the Party to serve the officials with the court order on Friday, the Legal Adviser of the party and Admin Officer refused to collect the court oder.



The bailiff was left with no alternative than to paste the order on the wall of Secretariat of the party as provided by law. 


Time will tell whether the leadership of the party will violate the order of the court and conduct primary or put its house in order before the conduct of the exercise.
