MAN TO DIE BY HANGING FOR KILLING NEW BORN BABY BOY IN ADAMAWA

A 50 year old, Saidu Abdullahi of Tarawo ward in Song Local Government Area, Adamawa State is to be hanged by the neck until confirmed death for killing his new born bouncing baby boy.

The convict and resident of Tarawo ward in Song LGA, caused the death of the innocent child by strangulating him to death on the 9th March, 2013.

Saidu was apprehended and charged to the State High for the offence of culpable homicide contrary to section 221 of the State Penal Code Law.

Delivering judgement after finding him guilty of taking the life of a harpless child on 20th May, 2019, the High Court presided by Honourable Justice Nathan Musa, convicted him to death.

Justice Musa told the convict that his hands were tied, and had no option but invoke the provision of section 221 of the Penal Code Law by sentencing him to death, and prayed God to have mercy on him.

Not ready to die, the convict later approached the Court of Appeal in Yola so as set aside the judgment of the trial court to enable him continue with his life.

To his rude shock and huge disappointment ever, the Appeal Court at its Yesterday's sitting presided by Honourable Justice Abdullahi M. Bayero, dismissed the appeal and affirmed the verdict of the lower court.

Justice Bayero said that it was clear that the appellant committed the crime based on the confessional statement he voluntarily made and that it was enough for conviction.

All that is required, according to him, is for the prosecution to prove its case beyond reasonable doubt, and that there were enough evidences that linked the convict with the offence, saying it was his act that sent the new born baby boy to his early grave.

He added that the validation of the conviction and sentence of the convict was a unanimous decision of the panel of judges, affirming the death sentence.

In the same vein, the Court of Appeal has upheld the verdict of the state High Court, convicting a 40 year old Abubakar Usman to 21 years in prison for the offence of murder.

The convict and resident of Yola South Local Government Area in Adamawa state stabbed one Shehu Jauro to death on the 23rd November, 2017 along Sokoto street in Yola South.

According to prosecution, the convict entered into the deceased car along Yola South main market to Sokoto street, but on their way misunderstanding ensued between them.

The prosecution added that the deceased stopped his vehicle and ordered the convict to get out of it, and that the deceased removed his belt and started beating the convict, while the other person who was together with them tried to separate them but to no avail.

On the process, according to him, the appellant removed his knife and stabbed late Shehu 2 times, and the deceased was later rushed to hospital, but was confirmed death by the medical personnel upon arrival.

Abubakar Usman who was arrested and tried at the State High Court presided by Justice Danladi Mohammed, was later convicted and sentenced to 14 years imprisonment not punishable with death and 7 years for the offence of causing grievous hurt.

The judgment was delivered in January 2020, and it is to run concurrently.

To seek for redress, the convict appealed the matter and prayed the Yola Court of Appeal to quash the decision of the of the trial court.

But the Appeal Court which was presided by Honourable Justice Abdullahi M. Bayero yesterday, dismissed the appeal, and however affirmed the lower court's verdict.

YOLA APPEAL COURT REFERS MAGISTRATE SHEHU'S CASE TO L/COURT FOR RE-TRIAL

The Court of Appeal sitting in Yola, the Adamawa State capital has referred back the case of the embattled Yola Magistrate, Shehu Mustapha to Federal High court Yola for fresh trial.

The Appeal Court held that the Federal High Yola which the matter was first heard and determined, lacked requisite jurisdiction to had delivered judgement on the matter due to the fact that as at the time of the judgment, the presiding judge had taken an oath and sworn in as justice of the Appeal Court.

Recall that the Federal High Court in Yola had in December last year, sentenced the former Chairman Nigerian Bar Association (NBA), Adamawa state chapter, Binanu Esthon and Magistrate Shehu Mustapha respectively, to three (3) years in prison each for conspiracy and fraud.

Earlier, the Economic and Financial Crimes Commission (EFCC) charged Esthon and Mustapha to the court on 7 count charge bordering on conspiracy and fraud.

Delivering her judgment, Justice Bilkisu Bello Aliyu of the court, convicted the duo for stealing and defrauding 502 retired staff of the Stirling Civil Engineering Nigeria limited in Adamawa in 2007 of N67 million.

Dissatisfied with the judgement, the convicts went and lodged their cases at the Court of Appeal in Yola, asking the court to quash the judgement of the lower court.

But the Court of Appeal in April this year, discharged and acquitted the former Chairman of the NBA, Binanu Esthon who was convicted for fraud and sentenced to 3 years imprisonment by Justice Bilkisu.

In an unanimous decision read by Honourable Justice James Shehu Abiriyi, the Court of Appeal resolved all the issues in favour of the Appellant, and set aside the judgement of the trial court.

After setting aside the judgment of the lower court, Justice James ordered the immediate release of Binanu, leaving behind the case of Magistrate Shehu for determination at later date.

Delivering judgement on the case involving Shehu today, Justice Abdullahi Mahmud Bayero of the Appeal Court, declared that the trial court was wrong to have heard and determined the case.

However, the Court remitted back the matter to the Chief Judge of Federal High Court for reassignment to a judge of the Court for trial to commence afresh.

According to him, with the elevation of the justice Bilkisu to Appeal Court, she lacked the capacity to entertain a case as a judge of the trial court.

Justice Bayero asserted that no doubt Justice Bilkisu was elevated in June, 2018 as the Justice of the Appeal Court, and that shortly, she took an oath and sworn in and that since then, she ceased to be a Judge of the Federal High but the Appeal Court.

He added that the issue of jurisdiction was not challenged at the trial court, but was raised before them at the Court of Appeal, saying that the issue of jurisdiction of a court to adjudicate on a matter can be challenged at any stage of proceedings, and should be dealt with first before the consideration and the determination of other issues in a case.

IN THE NAME OF PEACE, LEAVE CHIEF CROWTHER SETH ALONE

By Mallam Adamu Wanema, Public Affairs Analyst /Concern Citizen Adamawa State

I read with great sadness the unprofessional and malicious reports in the media attempting,in vain, to link the Deputy Governor of Adamawa State, Chief Crowther Seth, to the unfortunate crisis that recently broke out between the Lunguda and Waja communities in Dumna District, Guyuk Local Government Area in the state.

Having digested the trash I read, I decided to refrain from replying and let things be, but here I am responding to the feeble antics of desperate politicians who are envious of the superlative track record of the Ahmadu Umar Fintiri-led administration in the state.

However, seeing that the architects of this defamatory campaign are bent on poisoning the minds of the good people of Guyuk Local Government Area and the general public, it has become necessary to put the records straight.

As a lover of peace and diversity and after observing him over time, it is clear that Chief Seth is deeply saddened by the violent hostilities that now characterised the historic relationship between both communities. The deputy governor is committed to the ongoing efforts to find lasting peace and restore cordial relations between the warring kinsmen because he firmly believes that the ongoing efforts by the current administration in the state to bring development to every nook and cranny can only work in a peaceful atmosphere where people work together rather than against one another to ensure the delivery of good governance.

Chief Seth is a lover of peace and detribalised politician who rightly sees all of Adamawa State as his ethnic group. To him, differences of ethnicity, religion or gender are not as important as our shared humanity and destiny as a state. He therefore, will not and cannot be a party to any form of violence whether based on ethnic, religious, gender or political lines. Instead, he is committed to the task of building bridges of understanding and mutual respect among all ethnic groups in our dear state.

What does he stand to gain by fueling the violence between his brothers and constituents? It is implausible.

For the avoidance of doubt, Chief Seth does not and will not associate himself with any individual or groups, seen to be directly or indirectly stoking the flames of violence between both communities. He, therefore, rejects the attempt to link him with some alleged masterminds of the crisis.

Recently, he was quoted as saying: “I will not associate myself with an enemy of Adamawa State. Anyone who is capable of instigating violence in Adamawa State is an enemy of our state. As a Christian and a believer in the destiny of all the various ethnic nationalities that exist in our state, I have absolutely zero tolerance for any sponsor or mastermind of violence. I cannot associate with evil individuals and I cannot protect perpetrators of evil, no matter our relationship. To me, the safety and welfare of Adamawa comes first at all times, which is why I am delighted that the Executive Governor of Adamawa State, His Excellency Ahmadu Umaru Fintiri has announced the constitution of a Special Administrative Panel to get to the root of the crisis in Guyuk Local Government Area. I am very glad that the Administrative Panel is made up respected religious leaders and experts whose integrity is not in question. We shall give them our full support and ensure that they have the independence they need to discharge their assignment with let or hinderance.”

What more do these naysayers and vainglory writers need to hear from him?

As for the media organisations who embarked on this campaign of calumny against the deputy governor, where is their honour as purported members of the Fourth Estate? Is this how bastardised a profession we now have on our hands? Is there no price for reporting what defames, embarrasses, lies against and discolours the truth?

These media hack-writers must know and be prepared to pay the price for their unprofessional and unethical conduct and reporting.

It is nauseatingly baffling that some of these media organisations that pride themselves as defenders of human rights bother less about hearing and weighing Deputy Governor Crowther Seth before going to town with their hastily cobbled pastiche of so-called news reports...just because their sole purpose was to satisfy the wishes of their paymasters.

Well, the Office the Deputy Governor has assured that it shall sue.It is about time media houses learn some responsible journalistic ethics, even if they have to be taught by a few cases in court.

While Seth has promised to sue his defamers,he has, as a true elder,statesman,peace-lover and cultured leader, extended the Olive branch to the warring communities to sheath their swords and embrace unconditional peace, abstain from all acts of violence and give peace a chance.

It behoves on me and other sons and daughters of our great state to call on them to fully cooperate with the Special Administrative Panel established by the state government to investigate the recent crisis with a view to finding a lasting solution to the situation.
Only in the peace of these communities can we find our own peace, for if they keep on with the violence,we will have a large scale emergency on our hands .Our hands are full as it is and to be candid, this violence is totally avoidable.Let peace reign,my brethren.
