BREACH OF CONTRACT: COURT ADMITS EVIDENCE ON #4.3MILLION AGAINST GIREI LGC

Evidence of gross breached of contract to the tune of #4.3million filed against Gerei Local Government Area, Adamawa state has been admitted for trial by a Yola High Court in the state.

An Adamawa based company, Millennium Global Motors Nigeria Limited has dragged the council to the court over allegation of breach of contract agreement.

The company alleged in its statement of complaint that the Local Government had contracted it to supply it with a car at the cost of #4.3million, but failed to honour the agreement.

After the agreement, according to the complainant, the company went and supplied Honda CRV Jeep as demanded by the LGC and successfully handed it over to the LGC on 17th July, 2012.

The complainant told the court that the LGC paid the sum of #2million as part payment, and fixed 17th August, 2012 as due date for the payment of the remaining balance of #2.3million but failed to do so.

According to the plaintiff, the agreement was that the payment will be in 2 instalment, and that since the payment of #2million in July, 2012, not even a dime has been given to the company up to date.

But when the case came up for continuation of hearing at the Yola High Court presided by Honourable Justice Ishaya Banu today, the court admitted primary evidence tendered by the complainant against the defendant.

Justice Banu however adjourned the matter for continuation of hearing, and held that the next date for the hearing will be communicated to the parties involved.
