Adamawa State High Court sitting in Yola, the State capital has fixed 13th August, 2020, for ruling on the admissibility or otherwise of the confessional statements of 6 suspected armed robbers.
The court presided by Honourable Justice Abdul-Azez Waziri is to determine whether or not the confessional statements will be admitted as exhibit against the suspects.
The suspects, Afu Stephen, Peter Eli, Hassan Yusuf, Bobi Mabudi, Emmanuel Kenneth and Munbe Bala are standing trial at the Honourable Court on 5 count charge bordering armed robbery.
According to particulars of claim, the suspects had on 29th August, 2015, in Boshikiri town, Guyuk Local Government Area agreed to carry out an illegal act by mounting illegal road block along Lafiya -Savannah Sugar company.
It averred that Afu Stephen and 5 others mounted the road block along the road with drums and stones while armed with offensive weapons and robbed the said travellers of their belongings.
It added that the suspects had formed a common intention to commit robbery while armed with offensive weapons such as single barrel gun and double barrel pistol, saying that the suspects attacked passengers and carted away with their property such as money and handsets.
When the matter came up for the adoption of written addresses, Counsel to the Defendants, F. A. Ogbe prayed the court to reject the confessional statements sought to be tendered as exhibit by the prosecution.
On his part, Counsel to the prosecution, N. J. Atiku asked the court to admit the confessional statements, saying that the statements were duly recorded voluntarily without any torture.
N. J. Atiku urged the Court to dismiss the objection of the defence Counsel, saying it is bereft of merit, however and asked the Court to admit the statements.
After listening to both Counsels during Tuesday's sittings, the Court presided by Honourable Justice Abdul-Azez Waziri, adjourned the matter to 13th August, 2020, for ruling on the admissibility or otherwise of the statements.
