INEC APPEALS TRIBUNAL JUDGEMENT AGAINST MUSA BORORO
Independent National Electoral Commission (INEC) in Adamawa state has appealed the decision of the Election Petition Tribunal against the Member representing Mubi South constituency at the state House of Assembly, Hon.Musa Umar Bororo.
This is apart from the appeal the member personally instituted before the court of law, challenging his removal by the Tribunal over accusation of certificate forgery.
It could be recalled that Hon. Bororo (APC Mubi South) and his counterpart of Mubi North, Hon.Shuaibu Dan Musa, were sacked by the Tribunal over allegations of certificate forgery, and ordered the electoral body to issue certificates of return to Hon. Yakubu Musa Dirbishi(PDP) and Suleiman Yahaya Sudi(PDP) who came second with highest number of votes cast during the election.
The plaintiffs, Hon.Dirbishi and Hon. Sudi, had earlier filed 2 separate petitions against the affected Honourable members over allegations of tendering fake documents before INEC, which saw them making it into the race.
But dissatisfied with the judgment of the lower court, the electoral body proceeded to the apex court and instituted the suit, challenging the verdict of the Tribunal against Hon. Bororo, aside the appeal filed by the embattled member(Hon.Bororo).
Meanwhile, the Court of Appeal has fixed Monday tomorrow, for hearing in the appeals by the 2 affected Members of the Assembly, INEC and 4 candidates who also suffered a defeat at the Election Petition Tribunal recently.
Other appeals for hearing include that of Hon.Rufai Umar Gombi(ADC) Gombi, Hon. Vrati Nzonzo(APC) Lamurde, Peter Da'ape(PDP) Mayo Belwa and Mohammed Atiku Hayatu(APC) Uba/Gaya, who lost out at the Tribunal, and are challenging the elections of incumbent members including Japhet Kefas(PDP), Myandassa Bauna (PDP), Ibrahim Musa Italiya(ADC) and the current Speaker of the Rt. Hon. Aminu Iya Abbass(PDP).
NEWS PLATFORM learnt that all the appellants in this election matter have approached the Apex Court to determine whether the recent judgement delivered by 3 -Man Panel of Judges, led by Justice S. Akanbi, actually reflected the merits of their suits.
The fate of the appellants will be determined by three man panel led by Justice Chidi Nwaoma Uwa, after the hearing slated for Monday tomorrow.
This will put to rest all the legal tussle for several seats at the state house of assembly, engaged in by the never give up politicians who claimed to be reclaiming the mandates of their electorates.
In the case of Hon. Shuaibu Dan Musa and Umar Musa Bororo, the sitting members who were floored at the Tribunal, it is time that will tell whether the Apex Court will reverse the judgment of Lower Court to enable them continue in their representation, or uphold the verdict and then finally pack and leave the hallowed chamber.
On the other hand, it will certainly be a heart breaking judgement for other Honourable Members that won at the Tribunal if the Apex Court will upturn the decision, because there will be no more room for furthering their case, and the affected will be left no option than vacating the house.
