Court of Appeal sitting in Yola, the Adamawa state capital has struck out appeal against the member representing Gombi constituency at the state House of Assembly, Hon. Japheth Kefas.
The case was instituted by the candidate of the African Democratic Congress(ADC) during 2019 general election and former member who represented the constituency at the House of Assembly, Hon. Rufai Umar Gombi.
Hon. Rufai, was challenging the decision of the Election Petition Tribunal which dismissed his petition against Hon. Japheth Kefas(PDP) for failure for furnish the court with convincing evidence to get judgment in his favour.
The erstwhile member had earlier prayed the Tribunal to nullify the election of Hon. Japheth Kefas, over allegations of irregularities, and urged the court declare him(Rufai) as the winner of the 2019, elections and be issued with certificate of return as the winner of the polls.
But the lower court, presided by Justice S. Akanbi, quashed the petition on grounds that the petitioner could not be able to prove his case beyond reasonable doubt; thereby, dismissing it for lack of merit.
Hon. Rufai, who was not satisfy with the judgement, appealed the verdict and urged the apex court to set aside the judgement of the Tribunal.
But delivering her judgement on the suit today, the Chairman of the Appeal Court, Justice Chidi Nwaoma Uwa, affirmed the decision of the Tribunal, and struck out the appeal for lack of credible evidence..
